买了一年的condo,LD要relocate,打算出租。
我在这里研究生还未毕业,明年春季打算修online的课程争取不异地,明年秋季打算过
来跟同学合租一个学期毕业。
所以怎么都不会住这个condo了,目前只住了一年。请教大家,我家就我不改地址,拖
到明年秋季毕业,怎么操作可以让这个condo自住满两年?
出租的时候打算depreciation之类的,以后应该会卖,房价也涨了,所以自住满两年很
重要。就是不知道具体怎么操作,大家帮帮忙吧!

Don't pursue it. You need to make many lies along the way, not worth it.
A few factor to consider:
1. After the relocation, will you buy another house? If yes, then you can't
claim TWO primary properties.
2. You can not count depreciation of the condo when it's rented out, if it's
claimed as a primary residence.
3. Depending on the specifics, you might have a net loss for the rental
property which could offset your income. You can't do so for a primary
property.
4. You need tenant's cooperation to make it look like you still live there,
which ...

如果去另一边,先租,我去算travel,因为这里还没毕业,我的primary residency跟
老公的是不一样的,对吧?夫妻分居,同时能有两个?
最难的是 tenant的合作?如果租的人,同意我住里面,就能操作吗?

residence.
But if you believe the property market is going to go up, you will miss the
upside in the new location if you don't buy one there as soon as you can.
Plus, please consider the fact that you can still get partial tax benefits
by selling your condo later on even you lived there less than 2 years, you
are allowed to do so if the move is job related. Yes, you won't get full
benefits, but you won't violate any law, which if you do, it will hunt you
for a long time. Do you want to live under stress and guilty for many years
?
Also, if you make the lie now, when it's time to file tax next year, you
need to consider how will you file it - married filing jointly or filing
separately? With one location or two locations? When you make one lie, you
need to keep on making lies to cover it.
Your situation is quite common in the US, IRS has mature laws dealing with
such common situations, don't expect to get away easily by playing with IRS.

我本来是一个绝对遵纪守法的人,就是买房以前看过一本书,里面有一章就专门讲怎么
让两夫妻同时有两个primary residency,两年一换,噱头很大,算了20年的tax
benefit,记不得多少了,反正就被震撼了。
不知道是书里夸大,还是要对法律特别娴熟才能操作,或者书太旧,漏洞已经变了。谢
谢你的忠告!我还是plan点别的吧,过去是应该买房的,楼市这么好。

最大的问题:才买1年的condo,抛去买卖、交易费用,能有多少capital gain呀?就算
2年卖掉,算你净利润1万刀,省的税不过千把刀,何必折腾找房客这一系列让人头疼的
事情。如果2年卖掉,能有十万、二十万的利润,可能还值得折腾一下。

就算你真的住了2年,出租8年,10年后卖掉,还是要交capital gain tax的
貌似要按你住的年限和出租年限的比例算

If you file tax jointly, you can NOT claim two primary residences.
If you file tax separately, you can, but there are tax implications.
Other than your use of the property, there are many other factors IRS could
use to determine your principal residence, such as -
employment, tax return address, driver's license address, auto registration
address, bank statement address, utility bill address, etc.
Too complicated, as I said below, when one lie was made, many lies to be
made to cover it, not worth it.
There might be some tricks to be played based on some expert advices, but it
's probably beyond most ordinary people's reaches.

貌似要按你住的年限和出租年限的比例算

好像是要过去五年内自住满两年才行。
所以十年后卖还是得交税。
除非捂一年租三年然后就卖,或者卖之前回去住两年。

那如果是买的投资房给父母住,水电什么的都是自己交的,和自住的房子很近,这种情
况能算自住呢?
