申请时提交了9份推荐信：6份物理相关教授的，2份金融教授的，1份公司领导的，律师
Claim了以下6项来支持extraordinary ability in math/computational modeling
1. Award
2. Published Material/Media Report
3. Publication
4. Employment in a critical or essential capacity
5. Membership in association
6. Judging the work of others
IO发出了11页的RFE letter, 不认可所有6项。我很理解我的5和6都站不住脚，因为律
师拿我花钱就注册的学术membership和参加会议的经历就claim这两条了。 我开始太放
心让律师弄了自己没有把关，虽然提意见拿下这两条，但还是听律师的没有坚持，现在看
看真是巨大的错误。IO对其他选项几项的不认可总结如下:
1. Award
"You have not provided sufficient evidence to establish:
that the beneficiary's achievement are judged again other experts;
that criteria used to judge the receipts of awards;
whether the judges and/or award recipients are recognized experts;
that nature and scope of the award;
the national or international recognition of the wards;
how the awards are considered nationally or internationally recognized
awards;
that the beneficiary has received national or international recognized
awards for excellence of modeling in the field of business"
"You may submit evidences including but not limited to:
criteria used to nominate and judge the participants and award winners;
evidence that beneficiary or his organization receive funding, if applicable
, the criteria used to award the funding;
evidence that beneficiary was award a grant;
the origination, purpose, significance, and scope of each award"
2.Published material about you in professional or major trade publications
or other major media
律师拿我paper的citation claim这条了，而且也没有highlight媒体报道
结果IO称"Citations are not about the beneficiary or his work, rather they
are references. You have not provided published material...."
3. Publication
IO说这是science相关的paper, 要提供证据联系现在的business。
"You may submit evidences including but not limited to:
The significance and importance of the articles within the field;
The significance and importance of the publications within the beneficiary's
field of expertise that published the beneficiary's scholarly articles;
The publications' circulation;
How often the publication is printed;
The number of copies printed for circulation;
The number of citations"
4. Employment in a critical or essential capacity
这是应该最容易的一条，没想到也没被认可。
律师在这条里不仅claim我在现在银行是employed in a critical or essential
capacity, 而且在原来university也是。现在看来真是乱搞。IO认可银行和学校有
distinguished reputations，但不认可critical or essential capacity。
RFE的应对策略
我现在自己仔细看看IO的RFE和我的PL, 觉得IO给个11页的RFE已经很客气了...但事已
至此，现在就是抓紧时间处理RFE的回复。我的想法是承认membership和judging the
work of others不成立，把精力放在证明publication，employment in a critical or
essential capacity和original contribution。至于Award和Published material/
media report, 就放到次等重要的位置。我同时想再claim original contribution,
虽然原来PL没有claim但RFE letter里IO说你还可以claim，我想还可以找到领导证明自
己在公司的original contribution，加上原来学术上上的contribution，直接联系起
来就可以支持这一点了。
现在律师坚持RFE回信中要讨论并提供证据支持原来所有的6项claim，否则不好。对于
第4条，我跟律师说不需要谈我在学校的employment (就是一phd RA而已)，只要证明我
在现在银行的地位就行了，毕竟O1A是给现在工作的。而且我说我最多只能证明我在我
那些research projects里面是critical, 但咋证明我在学校里位置是critical。律师
还坚持把学校也加进去，而且说就谈我在research projects里面的重要性就行了。
现在还在和律师撕B中，公司只允许用他们指定的外面的律师，不能自己找很痛苦，希
望大家给点意见。谢谢！ | W***o

1） 用一大部分一开始就综述你的 achievement 是international／national
recognized。 主要
用你的推荐信来证明。
因为O1 的 最重要的条件就是 international ／national achievements are
recognized。
2） 你的publication 因该可以，如果 在google scholar 里面可以 查到有citation
，影响因子 和 citation。重点是按照RFE 把publication 和你的 business field 联
系起来。
3） 加上original contributions （按照EB1a 或1b 的程序claim contributions）
这三条应该就够了。
你的 awards 肯定不行的， 因为是公司内部和学生的奖。 awards 至少要全国级别的
。
critical role 是给公司的 CEO， 其他CXO，VP, director， lead project manager
之
类职务的人的
。 在学校
了是给 department chair 或者dean的。
citation 就是citation 不是published materials 或media reports
