p******y 发帖数: 236 | 4 Employer-Sponsored Petitions (PERM and EB-1b) – The 180-Day Rule
Changing employers or being laid off has a much greater effect on those who
have applied for immigration through EB-1B or PERM (EB2 and EB3), because
petitions in these preference categories require employer sponsorship.
Please note that, theoretically, the position offered to the beneficiary
alien in such petitions is a prospective position. The beneficiary alien
has up until the time when permanent residency is granted to take the
position. Therefore, there is no legal requirement that the beneficiary
alien of an EB-1B or PERM green card petition work for the petitioner at the
time of filing. However, in reality employers usually only sponsor workers
whom they already employ. Leaving an employer (for whatever reason) can
cause them to cease sponsorship of one’s petition.
According to current law, if an I-485 has been pending for 180 days, an
alien beneficiary of an employer-sponsored immigration petition may change
to a new employer at a position in a same or similar classification without
impact on his/her I-485 adjustment application if he/she has otherwise
qualified for an approval. There is no mandatory requirement that the alien
beneficiary must work for the original sponsoring petitioner during the
first 180 days, but the sponsoring petitioner must at least have the
continuous intent to offer the petitioned position during the 180 days. The
180 days rule applies to cases even if the alien’s I-140 has not yet been
approved. However, to be conservative, we suggest that aliens not change
employers until the I-140 is approved and I-485 has been pending for more
than 180 days. If an alien changes employers before the I-140 is approved,
the employer may request withdrawal of the I-140 petition and the whole
green card process will be terminated

以走了。在此之前如果拿到卡,可不可以提前辞职好像有争议,有人认为拿到卡就能走
,有的认为即使拿到卡,稳妥起见也应等到180天满。 |

以再交一份EB1A的申请如果你实在熬不下去。如果在等待期间绿卡批了也可以走。好运
