me (in the process of posting job ad). Alternatively, I can hire my own
lawyer to file EB2-NIW for me.
Since it will take a couple of months for me to get all the recommendation
letters for the NIW case, I wonder if there is any advantage for doing NIW
vs. regular EB2.
I understand that NIW requires no employer sponsorship and no labor
certificate. But they both have priority date, so don't really see the
advantage of NIW...
In my case, is there any advantage to file EB2-NIW over the regular EB2?
Can I file both concurrently?
If I file regular EB2, and I am in the middle of doing I140 and I switch
jobs, what happens? My priority date is still the Labor certificate date. Do
I need to refile the whole thing (LC and I140) when I move to the new job?

了，你的PD可以保留，如果140没有批准，那就没有PD可以带走了。

. In addition, it can be a great baton passing to your EB1A, in case you
hire a wonderful pro to handle the case.
Nowadays NIW is approved in a relatively short time if everything is
prepared accurately, neat and tidy. So your PD may be NIW's instead of perm'

@ilu: i think the PD is based on the date I140 is submitted for NIW and
Labor certificate is submitted for regular EB2. Correct me, if I am wrong.
I have one more quesiton:
Is it better to ask employer to file NIW or hire my own lawyer to do it? I
hear that if the employer is a big credible company (in my case amazon),
then it has an advantage to ask the employer to file. Is it true? I don't
know if my company does NIW either... |
