The petitioner must establish that it has the ability to pay the
proffered wage. The petitioner submitted a copy of reviewed balance
sheet for year 2009 and 2010. However, it is not one of the types of
the initial evidence..
.Please submit a complete copy of one of these three:
- Federal income tax return
- Annual report
- Audited financial statement
The evidence must be submitted for each year as of the PD and
continuing until RFE. If the petitioner employees 100 workers or more,
the petitioner may submit a statement from the financial officer which
establishes the petitioner's ability to pay.
我的问题：
1：我可以提供２００９，２０１０的公司税表，但是我的PD 是2011/11到RFE (2011/
11)这个之间的税表公司还没有报税，2011 fed tax return没有。
２：公司超过１００人。请教：公司的财务部声明如果有了，是不是就不用交上面３个
文件之一了？还是三个必须交，附加一个声明？
３：声明有没有模板？CEO签字可以么？下边我自己写的，请教有没有问题。

发帖数: 610 | 2 I also got a RFE (EB1B PP) of the ability to pay. In my case, HR faxed a
statement signed by the CFO of our university since the 2011 annual report
is not available until March.
I should be able to hear back from USCIS soon because it is PP. If you can
wait for a few days, I will update this post and let you know if sending a

gross revenue was higher than xxx.
