•AC21 Extensions in One Year or Three Year Increments AC 21 104(a)
An H1B visa holder can extend their H1B visa status in one year or three
year increments if a labor certification (PERM) or Form I-140 was filed at
least 365 days prior to the submission of the extension request or at least
one year prior to the completion of the 6th year. Additional extensions may
be granted until a decision has been made on the I-485.
假如H1B 明年9月20号到六年。I140 今年10月15号filed (filed 是指Priority Date
还是 Receipt Notice Date?), 如果在六年期间Outside US 有两个月可以Recapture,
那么H1B 六年到期Recapture以后 (到明年11月20号)如果绿卡还没有下来，H1B还可以
一年一年续吗? |

I140，才可以续H1b的。在H1b前5年期间Outside US 两个月听说是可以Recapture，请
咨询律师make sure. |

发帖数: 1865 | 4 我记得是PERMfile一年以上就可以延一年了，140批准后可以延三年，你的PERM批准以
后140可以要求premium processing, 15天下来。 |

发帖数: 1876 | 5 To be qualified for the extension,you need to file 140 (NIW/EB1)or perm one
year before the end of your 6 years' H1B visa.
So if you haven't filed anything before 9/20, you just run out of choice and
you need to file EB1-140 as soon as possible and will have 485 pending to
be legally staying in US or obtain the EAD card to be employed after you use
up your 6 years H1B.
Your two months of being outside US has to be documented with 797, otherwise
I don't think they will be counted. |
