拿到一公司offer,目前在办h1b,估计两周之后可approve;
公司坚持让俺提前上班(9月初),
这应该是利用了H-1B portability rule,
但据说h1b approval后就得停止工作了,直到10月初。
发信问了公司律师,没有回复。
请问如果h1b approval继续上班被发现的可能性大吗,有啥后果 (目前140正
pending)?

on H1 transfer ends when the cap H1 is approved.
So my question is, why use PPS in your case? The best strategy is H1
transfer regular service (can take 3+ months) and do premium in late
September.
If you work during gap, you can take a vacation anytime and return with H1
visa stamp before filing I-485. In that case, the illegal work will not be
a factor in your I-485 case. |
