245i, not every illegal can just file I-485A and qualify 245i, in fact only
few illegals can do 245i.
The first ever labor certification has to be filed 10 years ago, is that one
qualified?
Also, there is an 485 interview for people using 245i, did you go to the
interview? If denied before the interview, it usually means he doesn't
qualify 245i in the first place. |

剖腹产。靠我那点RA，肯定不够。所以我申请了medicaid, 费用全部是medicaid支付。

但还要看移民局会不会采取行动deportation。

245i? because nowhere 245i was mentioned in the decision. If I-485A was also
filed, decision must also address 245i.
2.so when was his PD? this should be a simple answer. And if he did submit
I-485 when PD is not current, USCIS can deny the I-485 without RFE (like
what happen to your case).
You know very little about several key issues in your case.
now you need to be able to show minimum
1 the Labor certificate or EB/FB I-130/I-140 filing evidence in 2001
2 The decision of that 245i eligible application in 2001.
3 PD of your current EB3 I-140
4 RD of your I-485, also the receipt showing filing of I-485A.

My husband filed his 9089 before 4/30/2001 the first time.
You are right that I just got to know that my husband should have had his
old submitting date for 9089 on his new PERM, but our lawyer didn't check
Yes when he filed the application for PERM. So on his PERM, surly 2007 is
not eligible for 245i.
We were suggested to file 9089 again and check YES to choose old submitting
date, so he can have 2001 on PERM.
Now I really want people who know some good lawyers to refer somebody for us.

Indian people tend to have far more complicated cases than we normally have.
The bottom line is I think your husband can still use 245i when his PD is current, but nobody knows when USCIS will look into his case and take action. Let's just hope for the best since it has been 10 years but your husband is still in US.
