Dear Friend,
Thank you for contacting me regarding visas for foreign workers in the
United States. I greatly appreciate hearing your thoughts on this important
issue, and I agree that our work visa programs should be reexamined as we
discuss comprehensive immigration reform.
Through a variety of visa programs, the Department of Labor allows employers
in the United States to hire temporary foreign workers. Most of these
workers fall under the H visa category. H-2A and H-2B programs are two of
the main visa programs used to bring low-skilled guest workers into the
United States - the H-2A visa program covers agricultural workers used for
full-time temporary or seasonal work, while the H-2B visa program covers all
other seasonal or temporary guest workers. There are also programs for more
highly-skilled workers, such as the H-1B visas for temporary professional
workers in specialty occupations like education, biotechnology, medicine,
and computer programming. Additionally, H-1C visas are given to temporary
foreign workers in the nursing field to fill jobs in hospitals. This program
was created in 1999 to combat the shortage of qualified nurses in many
under-served areas.
All applications for these temporary worker visas include a "labor market
test" to ensure that the hiring of foreign workers will not have a negative
impact on the American workforce. An employer must attest that a foreign
worker's wages will equal the wages paid to other employees in the same job,
or equal to the prevailing wages for that position, whichever is greater.
An employer must also ensure that a foreign worker's working conditions will
not adversely affect the working condition of other employees. Additionally
, in many cases an employer must conduct a search for qualified American
workers to prove that foreign workers are needed. While I understand your
concerns about these programs, there are many North Carolina businesses
whose success and survival have become dependent on foreign workers because
those industries face a shortage of qualified American workers - for
instance, the fields of nursing and agriculture. I support allowing
companies to hire foreign workers if there are not enough American workers
to fill the needed positions. We must protect American jobs, while also
ensuring that North Carolina businesses can be competitive.
I do believe these temporary worker programs should be reviewed within the
context of comprehensive immigration reform. I am committed to achieving
practical, bipartisan, and comprehensive reform that will address the
problem of illegal immigration at its core and streamline our immigration
system. For too long, Washington has failed to enforce our laws and address
the growing problems associated with illegal immigration. I oppose amnesty,
and I believe we must first and foremost strengthen our borders, crack down
on employers who knowingly hire illegal workers, and shut down the
underground economy. With our economy in peril, it is more important than
ever to create a comprehensive immigration system that protects American
jobs and wages. I believe these reforms can streamline our temporary worker
programs, as well as help North Carolina businesses play by the rules and
have the resources they need to legally compete and thrive.
