The bill would add a requirement to try to safely retreat before using
deadly force against an intruder, remove “robbery” and “aggravated
robbery” from a list of crimes that allow deadly force outside of a person
’s home and changes certain language, such as adding “habitation on land”
when referring to using deadly force to protect property.

发帖数: 13752 | 7 英文原文是这个含义吧。方框内是现有法律条文。habitation相当于自己家户内，我的
理解。这个条文还是很清楚的，自家户内not required to retreat.
大德州人民还是V5，我在的州，现在就不允许向入侵自己家草坪的人开枪。当然，如果
早有这个法律，那个日本留学生也不会被打死了。

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Sections 9.32(a) and (c), Penal Code, are
amended to read as follows:
(a) A person is justified in using deadly force against
another if the actor:
(1) is [if the actor would be] justified in using force
against the other under Section 9.31; [and]
(2) is unable to safely retreat; and
(3) [when and to the degree the actor] reasonably
believes the deadly force is immediately necessary:
(A) to protect the actor against the other's use
or attempted use of unlawful deadly force; or
(B) to prevent the other's imminent commission of
aggravated kidnapping, murder, sexual assault, or aggravated
sexual assault[, robbery, or aggravated robbery].
(c) Notwithstanding Subsection (a)(2), a [A] person who is
in the person's own habitation [has a right to be present at the
location where the deadly force is used], who has not provoked the
person against whom the deadly force is used, and who is not engaged
in criminal activity at the time the deadly force is used is not
required to retreat before using deadly force as described by this
section.

发帖数: 13752 | 10 仔细读了一下上面那个条文，楼主的解读有点不对，德州现在用的是stand your
ground law，并不是城堡法。这个提案是要把它改成城堡法。
这个不容易过，除非德州真的变蓝。

发帖数: 7 | 11 大概的意思就是院子没法用deadly force了呗，除非坏人拿着枪直接威胁。感觉跟麻州
都差不多了。麻州是坏人的脚在房子墙踢脚线以内才算homedefense。在院子里，万一
动枪，只能从self defense上想办法，然而麻州没有stand-your-ground这个条款，所
以只能往屋子里跑。
