,新学校合同8月份开始,中间有3个多月的间隔,貌似必须离境重新签证以免非法滞留
。鉴于H1B PP要被暂停掉,常规处理时间已经8个月了,岂不5月离境后直到年底才能回
来?这个问题似乎对用H1B的faculty都存在,大家都是怎么处理的? |

局有可能不收,所以才在担心。楼上是自己出的钱么? |

填表后,把表格和支票寄出去,“学校的人”说的纯属胡说八道
至于是否必须离境,要看前一个h1上的失效日期和后一个h1的生效日期是不是重叠,以
及后一个h1是否同时要求了extension of stay,最好找学校问清楚,同时咨询个靠谱
的律师,或者如果实在搞不清楚,可以打电话和email给uscis客服询问

不算。除非第一个H1B revoke,第一个学校吃饱了撑的去revoke,这也需要花律师费的
。
你根本不用加急处理,第二个H1的receipt接到就合法了。批准会从追溯时间的。

is the expiration date on the 797 of your current H1,you need to make sure
that the expiration date on the 797 of your current H1 is later than the
date your new H1 was filed, and you submitted your latest pay stubs with the
new H1 application. in that case, if your new H1 required extension of stay
, which mostly certain is true (you can ask your employer whether they
required it), you can use your receipt of new H1 to immediately start
working for the new employer, or you can continue to work for your old
employer up until the expiration date of your old H1.this is the so called '
h1 transfer', which is officially called 'h1 portability'
in theory, you need to work to maintain your H1 status. that means you
cannot simply stay in the country without working for three months and at
the same time claim that you are on H1 status. But that is theory. Many
people take a few days or even weeks leave between two jobs and nothing
happens, because their new H1 is filed while the old one is still in effect.
however, it is not certain whether taking a three months leave from
employment and remain in the country would be fine. in theory it is not. in
practice it may not be an issue. but you cannot be sure unless you ask USCIS
for their official opinion. now what is the expiration date of your old H1
797? What is the requested start date of your new H1? did your new employer
requested extension of stay? I suggest that you ask USCIS about it to be
safe. everyone's experience is different and others' experiences may likely
not apply to your situation, just saying
and the easiest way for you now is to pay the premium fee and get approval
within days. that's the easiest way

considered as employment. For example, in the summer, if the faculty still
works on applying projects, meeting with students, is that sufficient to
maintain his H1 Status?
