waiver材料办理今年H1B申请。想请教下我的情况是否只能J1 waiver以及现在waiver是
否来得及申请H1B。
1. 签证背景：
15-16年我通过国内学校资助的短期访学项目在美国待了一年半，申请过两次J1签
证，一次半年（15年2月-8月），一次一年（15年10月到16年8月），都受两年限制。看
网上搜索结果是按后一个起算。18年我申请了F1签证，从18年9月-19年12月硕士项目。
20年2月即将入职，并通过公司申请今年的H1B。
2. J1项目结束后的出入境时间
16年8月23日：出境
18年8月11日：入境
19年1月7日：出境
19年1月18日：入境
之后一直待在美国。按出入境时间来说，离两年差1天。之前提交材料的时候，因
为自己的疏忽以为满2年了就没有申请waiver。并且，17、18年我也有去别的国家。这
样，在中国没有待满2年。
因为我F1签证是1年期，现在回国就得重新申请F1。并且即将入职，再考虑到新冠
肺炎影响，回国待满两年似乎也不现实。
3. H1B申请时间线
公司是让Fragomen代办的H1B。给的时间表要求，3月1日前提交材料，3月20日前公
司会提交Cap registration。看之前帖子的时间线，申请J1 waiver都需要几个月。也
看到有J1 waiver，H1B同时办的。想请教下如何跟公司沟通呢，是直接把情况都跟他们
说，请他们同意同时办；还是我应该找移民律师跟他们讨论呢？

情况更新：非常感谢大家的帮助与建议。我给Fragomen（公司代办H1B的）写了邮件，
陈述了自己的情况，询问他们的意见，还没有收到回复。另外，今天我自己开始申请J1
-waiver。新的问题是，我第一张DS2019表找不到了，只有一张照片，不如扫描件那么
清晰。原件只有更新过时间的DS2019表，与第一张SEVIS ID一样。似乎waiver的时候只
需要复印件，没有用到原件的时候？那以后申请H1B会有问题么？ |

发帖数: 906 | 9 你这种情况，大概率是来不及了。你的当务之急是考虑备选方案：今年如果没有H1b，
是否可行。
然后，在你能保证继续在美国待下去（至少半年）的前提下，你可以开始办理J-1
waiver。第一步是向中国大使馆申请。如果你能找到内部的熟人帮忙，这一步可能被加
速。这步完成了才谈得上是否同时申请。事实上，现在H1b基本都要抽签，这里面的变
数太多了。

It means you must return to your home country for a cumulative total period
of at least two years. You are not prohibited from travelling to the United
States. , However, you cannot do any of the following until you fulfull this
requirement:
Change status in the United States to a nonimmigrant temporary worker (H
) or intracompany transferee (L);
Adjust status in the United States to immigrant visa/lawful permanent
resident status (LPR);
Receive an immigrant visa at a U.S. Embassy or Consulate; or
Receive a temporary worker (H), intracompany transferee (L), or fiancé
(K) visa.
There is a provision in U.S. law for a waiver of this requirement by the
Department of Homeland Security (DHS), U.S. Citizenship and Immigration
Services (USCIS). The former exchange visitor must apply for the waiver. The
Department of State, Waiver Review Division must recommend the waiver to

You must obtain a waiver approved by the Department of Homeland Security
prior to changing status in the United States or being issued a visa in
certain categories for travel to the United States. |
