小公司，Net Income和我现在的工资加起来达不到PERM的prevailing wage （被没有经
验的律师坑了，他当时PERM的时候只问了到时候我老板能不能付这个工资，我老板说可
以，律师也没看我们的tax return就直接file了)。我在网上查到资料说除了Net
Income之外如果能证明 Net Current Asset 能大于proffered wage 也行。

Additionally, according to the Yates Memo, a USCIS officer can make a
positive determination in regards to ability to pay through: net income, net
current assets and/or employment of the beneficiary as below:
1.Net income: The initial evidence reflects that the petitioner's net income
is equal to or greater than the proffered wage.
Net current assets: The initial evidence reflects that the petitioner's net
current assets are equal to or greater than the proffered wage, just as with
net income.
2.Net Current Assets (“NCA”) are the difference between a company’s
current assets and current liabilities. The calculation of net current
assets is done through an examination of a company’s tax returns. USCIS
allows an examination of net assets as some assets are not necessarily
included in the calculation of a company’s net income but evidence a
company’s financial stability. The calculation of net current assets
depends on the type of tax returns filed for the company (e.g. Form 1120,
Form 1065, etc.)
Note: Net Current Assets CANNOT be used to offset any shortfall in the net
income, i.e., NCA cannot be combined with the net income to prove ability to
pay. In order to prove ability to pay, USCIS will either take the net
income or NCA.
我的律师说他只知道从 Net Income 去证明Ability to Pay,没听说过用Net Current
Asset 的，所以我想问版上有没有经历过的或者知道这方面信息的达人。

1 补发工资差额到prevailing wage..
2 交老板税表和statement 进行personal guarantee. | s******3

发帖数: 367 | 4 140 个人只交3个月的pay stab.. 如果工资差得不多,补是最直接的办法..因为你已经
发到PW了.
我看版上有人问公司财务不佳,怎么证明支付能力,最后就是老板个人支持的...律师说
不行可能是律师不愿意做. rfe本身没有标准答案..要自圆其说需要律师想办法...不是
他说当初没看税表就开脱了的..

Net current assets are the difference between the petitioner's rrent assets
and current liabilities.' A corporation's year-end current assets are shown
on Schedule L, li s l(d) through 6(d). Its year-end current liabilities are
shown on lines 16(d) through 18(d). If a end-of-year net current assets are
equal to or greater than the proffered wage, the petitioner is able to pay
the proffered wage out of those net current assets.

所以说只要Net Current Asset 大于等于 proffered wage就可以证明 ability to pay
是吗？这跟我找的是一样的，应该是可以用的。
我的律师以前从来没用过这个，他不知道。。。我把这些link发给他他也没仔细看，哎
，得好好跟他辩论一番了。
