发帖数: 19 | 1 各位前辈和大神， 本人 EB2 PD 06/2014， 有EB2 approved 的140。现在看到EB3一排
前进到08/2014。 所以想让律师在4月份 concurent filing EB3 140和485。 可是律师
的回复如下， 说可以降级，但是不能concurrent filling。我本人不是很懂， 但是看
论坛很多人都说可以concurrent filing，请大家帮我看一下律师的回复，然后帮我看
看为什么不能concurrent filing呢。
We can file a new I-140 to request a downgrade, however, we can't file the I
-140 and I-485 concurrently. We can't file concurrently because we have
already submitted your original Labor Certification with your last I-140
application. If you want to premium process your I-140 application, we would
have to file the I-140 application and then file the premium processing
request 30 days afterwards. This allows USCIS time to request your original
file (which has the original Labor Certification) from their records
department.

但是同时pp可能会被拒，一般file后几星期后再pp比较好
你可以要求律师先同时file 140和485
等拿到receipt了再要求pp |

难道不能同时file140和485是因为original perm was submitted with the first
140？ 有没有哪些原因 会导致不能concurrent filing？还是就是有的律师不愿同时
file？

file eb3年140和485 用eb2的 PD是么？ 我就是对这些都不太了解。。。怕自己理解的

所以只好听律师的了 多谢大家的回复 |

批了。
你的PD仍是第一次交485时的PD。
