标 题: 申请485时没有有效签证,这种485会批吗

周五是有效身份的最后一天，周五485填写，与140一起寄出，周一uscis才收到，然后
的rd也是周一
。中间有gap,请问这种485实际操作上会批准吗？ | k******k

notified of the lay off.

公司lay off你以后，可以revoke你的H1B以及140。 如果140 revoke了，就谈不上485
会不会批的问题。
当然有些公司可能动作没那么快，或者说不知道或者忘了revoke。
所以你目前的策略首先是看能不能要求公司先把你暂时还放在payroll上，用你的假期
，就说你还要找工作，需要时间等等。

你的140已经递交了有些日子，那么移民局肯定早就就收到了你的485（跟140一起收到
的），怎么又变成了最近这两天的事情呢？

this computer.
the 140 is approved in this month.

你是否已经收到了485的收据？如果是，那么问题不大。这说明了移民局承认了你提交
485的时候在美国的合法身份。移民局主要看的是你提交485的时候，你的H1B的I-94是
否有效，你虽然被公司layoff，但是你公司未必及时向移民局汇报，就算及时汇报了，
移民局未必及时收到，毕竟这中间只有两天。

were out of status when submitting the 485 petition, as long as the period
is no longer than 180 days, the uscis can still approve your 485.
it was very miserable got laid off right before the new year, especially for
those family solely dependent on one h1b holder.

法，如果你无法证明你当时的身份是合法的，那么你的485会被reject，不会有收据，
支票也不会兑现。2，审理485的时候，签证官要检查你是否曾经有过身份违例，如果你
是h1身份，即使有短暂的身份违例（好像叫什么245i条款），也不会影响485的批准。
你说的是后一种情况，但不论如何，你都完全有理由乐观。

发帖数: 501 | 15 i read the 245 k closely, and combined with 245c. 245 k merely states that
as long as the total illegal stay in the u.s. is no more than 180 days, your
485 will be approved. meanwhile it says that 245k is the basis to waive
certain bars set in 245c(2)and (7), so i went back to check 245 c(2) (7),
which says
245c (2) 1/ subject to subsection (k), an alien (other than an immediate
relative as defined in section 201(b) or a special immigrant described in
section 101(a)(27)(H) , (I) , (J) , or (K) ) who hereafter continues in or
accepts unauthorized employment prior to filing an application for
adjustment of status or who is in unlawful immigration status on the date of
filing the application for adjustment of status or who has failed (other
than through no fault of his own or for technical reasons) to maintain
continuously a lawful status since entry into the United States;
(7) 2/ any alien who seeks adjustment of status to that of an immigrant
under section 203(b) and is not in a lawful nonimmigrant status; or
so in combine, even when filing 485,the alien is not in legal status, as
long as the total days of such status is not more than 180 days, the 485 is
fine.
I original misunderstood the rules and thought that even the illegal stay
was less than 180 days, when you file 485, you must have a legal status (
visa), but now it seems that my interpretation was totally wrong.

发帖数: 501 | 16 i thought when they accept the 485 application, when will check your current
status as well. but i was confirmed by another attorney, when the mail room
do the initial review before cashing the check, they just merely make sure
the visa number under this category application is immediately available,
along with other clerical check such as signature stuff, there is nothing to
do with your legal status at all.
