extension在10号那天批准了。就是新的批件上没有I94(关于这个问题俺前几天在版上
问过,搜搜俺的post),虽然俺还没有看到批件,只有给的扫描件。

It is currently taking about 4-4.5 months for H-1Bs to be processed.
Therefore, unless we get your completed packet very soon it is likely that
your H-1B will not be approved before you leave in February.
Since you have a valid advance parole/EAD card, you would be able to leave
the U.S. and return without needing the H-1B approval.
However, if you do that you would essentially lose your H-1B. When you
return to the USCIS you will need to work pursuant your EAD card because
you are no longer eligible for the 240 days of work authorization that you
get based on a timely filed H-1B extension. That option is only available
to H-1B employees that remain in the U.S. after the renewal is filed and
pending.
Your other options are to either (1) premium process the H-1B petition to
ensure it is approved before you leave. Of course, this option is quite
expensive given the $1,225 premium processing costs or, (2) remain in China
until the H-1B extension is approved. I can send the approval documents to
you via FedEx and you can apply for an H-1B visa stamp at the U.S. consulate
abroad. Then you can re-enter and resume employment in the U.S. on the H-
1B.

c**2 发帖数: 8496 | 7 Yes you can travel with AP, but as your university says, you no longer have
H1B pending work authorization (up to 240 days) before the extension
approval (if you will return with AP before extension approval). During
such time, they need to see your EAD to let you continue working legally,
and thus it maybe a question that the H1 approval needs to be re-activate by
reentry with visa stamp or you can continue to work using EAD until you
gain H1B when it is convinient for you to reenter with visa stamp.
But if you return to US after H1 extension approval, I think entering with
AP is fine to continue your H1 status, no need to use EAD. |

I am still a little confused.
The lawyer at my university does not mention the possibility of reactivating
by reentry.
How to reactivate by reentry with visa stamp? Does it mean that I have to
visit the Embassy to get a visa? |
