H1B第八年。现另一公司给出OFFER大约30% RAISE，且地方是我一直想去的，但是有以
下顾虑。
1，是否要求H1B TRANSFER。TRANSFER 后还是三年吗？
2，新公司要求开始时间能尽快。但我的理解如用AC21则需等到十月份。这对GC有何影
响或隐患?
3, Is the current company still able to do anything to jeopardise my GC
process in anyway at this stage?

第二个问题：why wait for 十月份？
对gc,多半会有rfc,但只要是相同工作性质，应该没问题。
第三个：mostly unlikely.

果I-140被revoke，你的I-485会被拒。 |

■New employment must be the "same or similar" occupational classification;
■Form I-140 has been approved, or is approvable when filed concurrently
with I-485;
■Form I-485 has been pending for at least 180 days.

what if I quite job from previous employer after submitting I-485, and then
after 180 days of I-485 pending, I find another same or similar job. And of
course my I-140 is still good for more than 180 days at the same time. Is
this case acceptable? I don't see it violates any rules of AC21 listed above. |

legally staying in the states without H1B (quit job for this instance) IF
your future GC can be granted, but illegally IF the future GC application
gets rejected and the out of status day starts when you quit the current job
.
This is kind of sounded absurd, but that is to my best understanding.

something in future with uncertainty.
As long as you are in AOS, you are in AOS status. If GC is rejected or
granted, your AOS ends, and you need to move to next status (e.g. either GC
or find a F1 or going home, etc.)

发帖数: 194 | 12 Maybe that is more reasonable to define "out of status" beginning day...an
upcoming question is that if the 485 gets rejected, the applicant gets out-
of-status immediately, which means the EAD card lost its validity even
before the card expiration date.
As his/her H1B is automatically given up when EAD takes effect, and there is
no grace period before status change, he/she becomes illigally staying the
same day when 485 rejection letter was issued, which is horrible.
So doing the H1B transfer is necessary as long as 485 approval notice is
received.
