3/12/2012: Hope for Irish E-3 Visa & H.R. 3012 Reportedly Faded Away
Today, Irish media reports that all attemps to negotiate and pursuade
Sen. Grassley have failed and they are losing their hope for these bills in
the Senate. It indeed is a grim news.
As the H.R. 3012 prospect was slowly slipping away, the Indian and
Chinese communities have been hangging on with the prospects for removal of
per country limitation to EB visas as inspired by the White House report
that the President supported so-called STARTUP programs including removal of
per country limit for Employment-Based immigration. For the reasons, people
have been closely watching the movement in the House on the JOBS bill which
people hoped to pick-up and include the H.R. 3012 type of per country limit
removal proposal, but as it has turned, the JOBS bill which the House
passed last week failed to include per country limit proposal to a great
disappointment to the Indian and Chinese communities. Worse yet, during the
weekend, Senate Majority Leader Harry Reid disclosed his position on
immigration reform in connection with the sad story which media reported
headlined on a Mexican girl child who had been brought to the U.S. illegally
by the parents when she was four years old and excelled at the high school
as a Valedictorian but was now facing deportation by ICE that Sen. Harry
would not accept any piece-meal immigration reform legislative proporals
unless they included DREAM bill. During the same period, there was another
report on a Mexican student who graduated from the New York University Law
School after he had been brought to the U.S. when he was five years old and
facing no future for his dream of becoming a lawyer as he would not be able
to obtain a lawyer licence. These two DREAMer stories tore apart and broke
the hearts of the public last week.

03/11/2012: Frozen EB-2 Cut-Off Dates for India and China in April 2012 Visa
Bulletin as Predicted by the Department of State in January 2012
Before the April 2012 Visa Bulletin was released day before yesterday, there
had been all sorts of rumors in the Indian and Chinese community websites
including predictions that there would be a progress to "Current" in April
2012 or at least move another six months. These specutions remained rumors
because they somehow lacked the knowledge of how the employment-based
immigrant visa numbers were allocated. The goal of the federal government is
to use up annual quota of 140,000 before the end of each fiscal year and
the State Department is responsible to allocate the annual visa numbers
quarterly considering various factors and predictions. However, no matter
what factors they take into consideration in allocation of EB visa numbers
in each quarter, the State Department may not likely completely open up
monthly EB-2 visa number into "Current" in any month because it may
seriously and negatively affect its sister federal department of USCIS in
that under the current USCIS filing fee schedules, I-485 applicants are
required to pay filing fees for EAD and AP only one time and will get
extension free of any filing fees pending I-485 applications, no matter how
many years it will take. Opening up of the visa cut-off date to "Current"
will potentially create a flood of I-485 applications pouring into the USCIS
during the month or months which exceed the annually allocated EB visa
number limits. It means that a large number of these I-485 applicants will
keep extending their EAD and AP "free of charge." Future revenue of the
USCIS, which is fee-funded revenue, will likely be negatively affected by
these large number of "free of charge" EAD and AP applications which are
created by opening of EB visa cut-off dates to "Current."
Other than such business consideration, there are also several other factors
that can come into play. One of those factors include upward and down ward
spill over of the visa numbers among EB-1, EB-2, and EB-3. Currently for
India and China, it is inconceivable there can be upward spill over of
unused visa numbers from EB-3 to EB-2 or from EB-2 to EB-1. Therefore, the
spill over one can count on is downward still over from EB-1 to EB-2. State
Department disclosed earlier that the demand for EB-1 numbers were very low
and State Deparment based advancement of EB-2 for India and China in March
with their assumption that 12,000 EB-1 numbers will go unclaimed. Only about
35% of the available green cards have been issued during the FY 2012 (from
October 1, 2011 to end of January 2012), and approximately 45% should be
issued by the end of February. Based on such data, the State Department
predicted that the EB-based priority dates would likely move ahead in March
2012 Visa Bulletin, at least a few months. It predicted that an advance of
six (6) months was possible and an advance of much more than that would be
unlikely. Indeed, this is what happend in the March 2012 Visa Bulletin! It
also predicted that after March 2012, DOS would likely hold the EB cut-off
date over the summer, and then retrogress or advance cut-off dates depending
on the I-485 demands during the period. It appears that the State
Department may not have the data to predict demand and priority date changes
for the last quarter of FY 2012 (July through September 2012). In other
words, until these demand data become available for the 4th Quarter of FY
2012, the State Department would not be in a position to release its
prediction for the 3rd Quarter (April thru June 2012). Under the
circumstances it predicted that the EB-2 for India and China might get to
stand-still, or small move or even retrogression before the end of FY-2012.
We hope this does not open.
