充条款通知被check，他是biomedical 专业，不是主申请人。
他的AP Feb.24网上approved （NSC)，March 2nd 收到combo卡，上面validate日期从
Feb 24开始。
1）请问他的AP 有效吗。
2） 如果有效， 我可不可以把AP寄回去让他用AP回来啊。护照可以在visa check期间
要回来with 221g stamping。用AP+护照回来。
3）他需不需要withdrawal visa，如果AP过不来，他是不是被送回国，还可以等visa
clear后过来。

信免interview代签.他也没想到这次会被check.H1身份真是可怜啊.现在实在是没办法.
也不知道这样做可不可以.

if there is a way to salvage your 485 case, basically we are talking about
the invalidation of your 485 application.
As per our lawyer, for all visas except H1B/H4 (there is one other visa type
also has this benefit, but I forgot what that is), once you submitted 485,
simply forget about traveling until you get your AP. For H visa holders,
however it's fine, but there is a caveat:
Basically, for H visa holders, the rule of thumb is to have your status the
same between leaving U.S. and coming back. Say, you leave as H1B, you come
back as H1B; Or, you leave holding AP, you come back using that AP.
If, if the status is changed during your international travel, you are in an
undefined state, it's very likely that your 485 application be voided, in
other words, you will not get your green card.
So, call your lawyer immediately to discuss.

发帖数: 724 | 8 No, at this time, using AP to come back is the last thing you want to do,
basically your spouse is looking for big trouble once he does that maneuver:
leaving U.S. on H1B visa status and coming back holding AP! that's textbook
case for boarder patrol to do whatever it takes to stop him from coming in.
The best thing you can do is to wait for the H1B check clearance (which only
takes 2, 3 weeks anyway nowadays). Come back on his H1B visa. He might be
able to come back, but still, his status is very bad, they will find it out
sooner (if not at the airport) or later. I know its a technical mistake, but
it's a mistake that you cannot afford so you want to do everything to avoid
it.
Again, call your lawyer right away to figure something out for your spouse.
