发帖数: 410 | 1 I got laid off and have changed my previous H1 to F2. Got another offer and
the new employ has applied for H1-B, they received the notice of receipt
from USCIS. It will take up to 4 months for it to be approved. The company
said if I cannot go within two weeks they will consider hiring someone else.
I know if I pay the PP fee it will be quicker but at this point I decided
either to stay at home taking care of my kids or taking a better offer as
there's a high possibility that I'm getting a better one.
My question is
1)Before the H1 is approved but pending with USCIS, can I keep using current
F2 and stay in US?
2)If H1 is approved but I refuse to work for that employer, can I keep using
my current F2 without doing anything or do I have to change the status from
the NEW H1 back to F2 again?
3)If another company offers me a job, can they start to apply for the H1
right away? I'm not sure if two H1 can be applied at the same time.

for H1B visa, without starting work for the sponsor, your H1B considered as
inactive, therefore your status maintain.
for the third question, unless your h1b is cap exemption,I know 2012 H1B cap
