conviction conditionally. Anyway, you can do some expungement work after
some period in order to delete your record permanently.
I don't think a misdemeanor will affect your I485. But begin and finish the
expungement process as soon as possible if you don't feel comfortable. | w*******g
发帖数: 9932 | 3 depends on the final disposition: max prison time of the charge, actual
sentence.
Usually misdemeanor means max prison time < one year. The sentence can be
probation, fine, suspended jail time (actually this counts towards actual
sentence as far as the immigration is concerned).
The magic number is 365. If the max sentence is 364 or less, you should be
fine.
Also, if this is not violent crime or crime of morale turpitude such as
stealing, you should be fine.
All you need to do is to write a letter explaining the situation and attach
a
court certified copy of the final disposition of your case along with your
485 application. You may get an interview or RFE for some additional
documents. But this is not bar for exclusion and you should get GC.

there is no chance for expungement.
