I got another question regarding the # shown in I-485 Yearly data. In the
spreadsheet, FY2009 Emp Adj Approval count is 130,352 but in the Yearbook
2009, the employment approval count is 144,034.
130,352 approval counts does not make sense because there is a long queue of
employment applicants waiting for the quota and the annual limit for
employment based is at least 140,000.
Why these two numbers are not consistent?

I believe there may be some confusion regarding the numbers you’ve cited
below. The FY2009 employment based adjustments approval count is 130,352;
however, the 2009 Yearbook number you cite (144,034) is for the total number
of employment based LPRs (both new arrivals and adjustments). The number
of FY 2009 employment based adjustments (per the 2009 Yearbook of
Immigration Statistics) is 127,135.
The I-485 yearly data reports the approval count for employment based LPR
adjustments. This means USCIS is counting the number of approved
applications. Once an LPR adjustment application is approved, the applicant
still must complete an interview and provide biometric information before
receiving full LPR status. Because of this, there are cases where an
application is approved in one fiscal year (and thus included in the USCIS I
-485 yearly data) but final LPR status isn’t conferred until the next
fiscal year (where they are counted in our statistical data).
Hopefully this sheds some light on the discrepancy in the numbers.

但是这个不合理，因为去年预批准的也不应该算到去年名额里面，应该算到今年名额里

由于移民局多年来大量浪费EB名额，使到中国EB2申请人出现长达5年的backlog，使到
现有的移民政策已变成一个严重歧视中国移民政策。违反了宪法，还是什么歧视法例的
。要求recapture. 这样行不行呢？
我不是律师。有法律经验的，可不可以给一些意见。

This is so confused. Couple of questions:
Who are those applicants? How can they get approved without biometric
information?
When the visa number is issued in such case, in the stage of 'an application
is approved' or 'receiving full LPR status'? |

我认为这个就是预批准的意思，但是这个每年都是有的。去年的预批准推到今年，今年
的推到明年
最后你按每一年算，应该还是要有14万+FB SO的，没有就是浪费了。现在必须说明白，
那个预批准的
2万多个不占2011年14万的名额才行。否则就是浪费了。
