ago. Now the position is reoppened. My questions are: 1. Can the employer
use this poistion to support his PERM application? 2. If yes, what is the
chance to get approved by DOL? 3. If approved, can he renew his H1-B and
start to work, or has to wait until he has chance to submit his I-485? |

Yes.

If processed correctly by the employer/employer's representative, the chance
of being approved should be
very high.
3. If approved, can he renew his H1-B and start to work, or has to wait
until he has chance to submit his I-
485?
Yes. He can change status from H4 to H1B, using an approved I-140, he can
also get 3-year extension. |

发帖数: 367 | 6 PERM 平均要四个月左右能交上去。
交上去后现在要六到九个月， 要不批， 要不审。
如果批， 交140。 140现在正常要一个月左右批， 加急永远都是两个星期以内批。
如果审， 现在劳工部很慢， 大概要一年半以上才有结果。
140没有假设补件或被拒的状况。 PERM做好了140就不会出状况。
所以你可以看出来， 每一个步骤都有未知因素。 大概就这样。

发帖数: 989 | 8 Unless he gets a new H1b after leaving US for at least a year, he is not
eligible for PERM when he is in H4 visa.
That's my understanding.
Even he could get a new offer but H1b six-year is used up.
What twoG said is for H1b IS still available (less than 6 years). Anyone
correct me if I am wrong.

公司是个国际大公司，作电子产品，有硬工，有软工，还有软硬兼工。但是这两年景气
不好，去年零零星星一直在大裁小裁的，所有的PERM都冻结。现在刚刚开始启动，但还
不能打广告。女的呢，在原来公司工作了将近四年，一直都没有办PERM. 换工作到这个
公司后，不巧赶上裁员，虽然工作保住了，但面临H1B九月底要到期了。老公倒是H1B，
140已批。她可以recapture 四个月的时间，还是不够。(In order to extend H1B
beyond maximum validity, one needs to have a labor cert. pending for at
least 365 days, or an approved I-140. This has been discussed many times in
many places.)
公司有御用移民律所，咨询律师咋办。律师说：
1。送到国外分部一年？公司说不可能，这是老微屁那个层次需要讨论的。对这个职位
没有那个待遇。
