for not stopping at right turn in red. The photo on the ticket is not very
clear at all, but the video can obviously show him did not stop. I replied
the ticket by saying not me, but received another letter asking for the real
driver's name. What should I do? Any lawyer in that area can recommend?
can we still have opportunity to take traffic school to avoid the points? |

发帖数: 12623 | 9 First of all, it's not a "real" ticket from a court asking you to show up.
It's a "snitch" ticket from the police department asking you to identify the
driver. Ignore it. Plus the law says that the picture must be clear.
What could they do? They could send you a real ticket. You would then go to
court and say it's not you. You would point out that the picture does not
show that it's you, either because it's not clear or it shows someone else.
You do not have to say who it is. According to the law they should find you
not guilty. There is a small possibility that if the picture is not clear
but looks a little like you (even though it is not you) they will find you
guilty anyway; but that is against the law and you would appeal that.
Or, if they are really smart, they can look up the address of the car, see
who else lives there, and figure out that it's your husband, and send him a
ticket. Then the only thing he can do is go to court and argue that the
picture is not clear, and does not prove it's him (but don't say it's not
him).

First of all, this ticket does have a court date and time.
Secondly, the replied mail is saying " the Affidavit of Non-liability must
identify the operator of the vehicle at the time of the violation. So my
first reply can not be processed. The court is only notified when a valid
affidavit has been submitted and approved by the police dept. I must respond
to this violation before the court date."
It seems I must reply... I have no time to the court btw. any other ways to
solve the issue??

Check your state law that if the owner is liable for the camera ticket.
If not, then you should be fine. |
