wouldn't make much of a difference even if you called the cops. and in big
cities, cops won't even come for minor accidents

small claim要是输了人会不会反过来说我诬告让我赔钱啊？点点钱我还是赔得起，就
是不想便宜那个driver。我就算small claim court赢不了也要折腾折腾她。

same time for damages, loss of wage because they have to miss work to come
to court, for example.
but you shouldn't have problem winning the case. best if you get pictures
or witness, including passengers in your car.
a lot of times, sues go to small claims court because the parties lack of
hard evidence, so the judge have to do a lot of judging on your words vs
his words.
you already have the surface evidence to your advantage, picutres if any,
and the fact that you got his insurnace info indicates you and him
exchanged info for SOME reason.
