he drove on the left lane. His car went into my lane and left deep scratch
on my passenger door (left side).
We both have insurance. It was rush hour (5:17pm) and dark and I can not get
anyoen as witness.
I called police. He is a black guy. Apparently he is sympathatic to that guy
(white 67 old man). The police told me that what that guy told him is
opposite to what I told him. That guy said I hit him. The police said he can
only write a neutral report and the insurance company will deal with whose
fault it is.
The insurance company estimated my damage to $791. They are going to send me
the check without me paying deductable ($300).
There are large area of patches scratch (silver becomes black) on my car
door. My car looks terrible. I went to some body shops for estimation. Some
of them gave me $1150 damage and some cheap ones gave me $800.
Should I just accept the insurance check or can I argue with them since they
gave me the estimate on the very low end?

I. file a claim with the other driver's insurance company directly. you
don't pay anything
or
II. file a claim with Your Own insurance company if you have full
coverage, then you have to pay deductible first because you are
technically filing a claim against your own insurance. then if it's
determined it's not your fault, your ins company will get all the money
back and refund your deductible.
on fixing the car, you have 2 options:
A. get cash - if you do NOT want to fix the car or want to fix it cheap
and pocket the differece, get 3 free estimates from 3 different body
shops, fax them to the insurance company and ask for as much as possible
or
B. get the car fixed - send your car to good bodyshop, ask them to bill
the insurance directly. Usually insurance company recommended bodyshop
are good; avoid dealer because most dealers do not do body work, they
tow your car to a body shop nearby and charge you $2000 extra.

who's insurance company? you don't pay deductible if you claim other
driver's insurance. if you are claiming your own insurance, $300 is
already deducted from the amount.
also, do not mention black or white, or yellow or brown. it'll only get
you in trouble
