BACKGROUND: 船舶工程美国PHD;PHD毕业后在一家中小型船厂做SENIOR NAVAL
ARCHITECT，为此船厂设计了一个浮船坞，并用此浮船坞将该厂建造的美国历史上最大
豪华游艇送下水。
IO承认了我的浮船坞及LAUNCH豪华游艇的 CONTRIBUTIONS，但没认我由此CLAIM的在该
厂Performing a Critical Role, 让提交证据，RFE信上这样写的：

先報TIMELINE:
• Dec, 2009, NIW approved
• April, 2011, started preparing EB1a (signed a contract with Attorney
Y. At that time, I only served as a peer-reviewer once)
• Aug, 2011, EB1A filed to TSC by Y. My background was 6 reference
letters, ~15 publications; ~100 citations (half non-self citations); ~15
peer reviewing experience; an American Heart Young Investigator award; Many

一下。 这个结果应该会比appeal快。
另外你的条件比很多过了的人都好，实在不行就重新pp file 一份，应该问题不大。
另外我有些糊涂， original work 是不是authorship? |

觉得case还行，一作要是5+，citation多是来自一作的话，contribution还是好证明的

发帖数: 676 | 14 Jerry Zhang 说的没有错。 而且appeal 拖的时间也比较长， 的确不值。但是motion
不是appeal, 会比较快出结果。 如果你想省律师费的话，可以自己file motion，把他
们没有考虑的证据强调一下。 重新file a new EB-1A, 你的胜算应该挺大的， 不过就
是要付一份律师费。时间上倒是不会浪费。 我记得在版上和我前后脚收到RFE的一个同学， 很快回复了，然后被拒。我因为没有材料可以应付RFE, 就一直拖到deadline才寄出去，后来幸运的批了。可是485已经等了近4个月了还没有消息。 那位同学被拒之后又file了一份1A, 很快就直接批了，也交了485，没准他比我还先绿呢。

12 papers, 30 reviews （RFE的时候多了5个）, 160+ citation.
claim 老三样 + critical role （律师强烈建议的）
8 original +3 RFE reference letter （8封独立含2 editor letters）

Approval：3/26
IO 是 XM1155. Google了一下所有含这个IO ID的网页（中英文），发现他/她从2009年
起，RFE了四个（不包括我），过了3个，拒了1个，75%的approval rate，应该算是好
IO。
RFE承认了authorship和review，不认可contribution和critical/leading role。给了
个模板RFE，不过对contribution特别提到要求补一些implemention的证据。
因为没有什么contract，license之类的东西，只好又找了3封新的独立推荐信，让他们
