• Dec, 2009, NIW approved
• April, 2011, started preparing EB1a (signed a contract with Attorney
Y. At that time, I only served as a peer-reviewer once)
• Aug, 2011, EB1A filed to TSC by Y. My background was 6 reference
letters, ~15 publications; ~100 citations (half non-self citations); ~15
peer reviewing experience; an American Heart Young Investigator award; Many
media reports regarding to the award. He claimed judgments, original works,
contribution and media report.
• Dec, 2011, RFE. Accepted judgments, but denied original works,
contribution and media report.
• Feb, 2012, DIY filed 485. Y said it was unnecessary to continued RFE
, but I continued preparing supporting documents.
• March, 2012. EAD, AP obtained.
• April, 2012. EB2 regression. I filed DIY documents response to RFE.
The background was updated to 2 new reference letters, 1 editor’s
supporting letter, ~17 publications; ~120 citations (half non-self citations
); ~35 peer reviewing experience. ONLY claimed judgement, original works and
contribution.
• Last Friday. USCIS accepted judgement and original works, but still
denied my contribution. 在據我的contribution 時，USCIS有且只提到8封推薦信，
隻字不提AHA獎，我工作的媒體報導，文章引用分析（與Harvard, Baylor的比），油燈
圖，大量的審稿經驗（journals have impact factor 1-8）。而且還抓住了3封推薦信

一下。 这个结果应该会比appeal快。
另外你的条件比很多过了的人都好，实在不行就重新pp file 一份，应该问题不大。

觉得case还行，一作要是5+，citation多是来自一作的话，contribution还是好证明的

发帖数: 676 | 11 Jerry Zhang 说的没有错。 而且appeal 拖的时间也比较长， 的确不值。但是motion
不是appeal, 会比较快出结果。 如果你想省律师费的话，可以自己file motion，把他
们没有考虑的证据强调一下。 重新file a new EB-1A, 你的胜算应该挺大的， 不过就
是要付一份律师费。时间上倒是不会浪费。 我记得在版上和我前后脚收到RFE的一个同学， 很快回复了，然后被拒。我因为没有材料可以应付RFE, 就一直拖到deadline才寄出去，后来幸运的批了。可是485已经等了近4个月了还没有消息。 那位同学被拒之后又file了一份1A, 很快就直接批了，也交了485，没准他比我还先绿呢。
