产生的海洋权利，以及菲律宾声称违反了《公约》的中国某些行为的合法性问题。考虑
到《公约》对强制争端解决的限制性规定，仲裁庭强调，它既不对任何涉及陆地领土主
权的问题进行裁决，也不划定当事双方之间的任何边界。

tribune”一职俺有些基本的理解想要提出来请您老斧正。
基本上共和国时期俺见识到的含有“tribune”字眼的官职有三个：Plebian Tribune，
Military Tribune，以及Consular Tribune。爱好者如我一开始接触到最多的是第一个
官职Plebian Tribune。因为此职位的设立体现了罗马平民阶层的崛起，所以一般中文
史书上也会特别强调。此职的重要性导致有时人们就直接使用单独的Tribune 一词指代
它。因此Tribune的对应中文翻译就是“保民官”。
但是后来随着理解的深入，发现其实第二个职位Miliary Tribune出现的更早，仅指军
事长官，贵族平民都可担任。而“Tribune”一词来自“tribus”（部落），本身并不
包含阶层划分。所以将 Tribune直接翻译为”保民官“其实是把”Plebian“中的平民
含义植入了进去。这造成了一个麻烦就是在翻译”Miliary Tribune“的时候，我经常

，不过以前有人这么用了，我也没见过更好的译名，也就这样沿用了。如你所说，和
tribune有联系的最早的职务是military tribune（tribunus militum）。最早是有部
族大会选出来的军事指挥官，地位在军团长legate之下，在百人长centurion之上。
Plebeian tribune是在494BC出现的，这个就是真正的保民官了，是平民和贵族斗争的
结果。tribune是平民大会（plebian assembly)选出来的，这个大会是按tribe或是
curia来组织的，所以选出来的代表称为tribune也就不奇怪了。这个大家都熟悉，就不
多说了。下一个consular tribune拉丁全称是tribunus militum consulari potestate
，翻译过来就是military tribune with consular authority，就是有执政官权限的

一年失效的。鉴于协议到期，罗马方面派出使节去Veii要求新的内容不详的协议(Livy
的说法是ask satisfaction，估计是对罗马有利的条款)，但是使节还没到达Veii就被
对方拦下来，并求罗马方面给一年的时间，因为此时Veii内部有原因不详的麻烦，我估
计是Veii内部权力斗争还未见分晓。当时Volsci人刚刚拔掉了罗马人在其境内修建的
Verrugo要塞，于是罗马人对Veii也就莫为已甚了。下一年，也就是406BC，罗马再次派
遣使者去Veii。这次Veii直接把使者给赶走了，同时还对使者进行了人身威胁。罗马元
老院的反应是要求consular tribunes（执政保民官，这一年没有执政官，只有四位执
政保民官）对Veii宣战。但是罗马平民对宣战不感兴趣，因为此时对Volsci人战争进行
得很吃力，虽然罗马人得以侵入Volsci人的地盘并建起要塞，但Volsci人的反攻也是很

个城市联合提议整个Etruscan各城邦联合起来为Veii解围。直接干涉Veii和罗马之间战
争的提议又一次遭到拒绝，不过这一次拒绝的原因变了。Etruscan诸城邦遭到了来自北
部的陌生民族Gaul人的大规模入侵，此刻已经无力分神照顾Veii了。Etruscan城邦最后
给Veii的唯一支持就是允许年轻人（有战争经验的要留下来对付Gaul人）志愿前去Veii

保民官。
英语的Social War是拉丁语Bellum Socii的翻译。这里面socii的本意是联盟。而且，
尽管social最常见的意思是社会，但是Webster给出的第一个解释就是involving
allies or confederates。只要知道Social War的来龙去脉，同盟战争就是必然的翻译
了。
Military Tribune翻成军事保民官不是席一家，很多人都这么译，但这不代表就是对了
。tribune这个词源自拉丁语tribus，本意就是部落。Tribune这种职务通常都是按部落
选举出来的。Plebeian Tribune,也就是常说的tribune是平民通过平民大会选出的，选
举方式是按部族投票。按照其职能翻城平民保民官或是保民官并无不恰当。但是对于
