his income.
If one citizen pays 10% of his income to the government, I should only need
to pay 10%. If one pays 50%, I should pay 50%.
As long as everybody is in the same tax bracket, subject to the same tax
rate, I am neutral to tax hike or tax cut.

大约4月13号mail tax file到NC,Check在21号被Cashed了。现在到IRS网站上都查不到
Tax Return Transcript。
给IRS打过好几次电话,他们建议过了这个周六就re-file。
我觉得是不是4.15附近太多人file了,IRS处理得很慢。
如果有人在4.15附近file的,能不能帮忙到IRS网站上查一查有没有Tax Return
Transcript,我好知道自己所在的位置。具体方法如下和见附图:

去年10月份左右买的房子在san jose,今年来了新的assessed value和tax refund。发
现数字怎么都对不上(我查的san jose的税率1.1%)
2011 税基:420K
2012 税基:390K
去年下半年和今年上半年各交了一次property tax:29xx
通知我tax refund:3xx
我的算法:调整前的tax:420k * 1.1% = 4620全年, 2310半年, 1155三个月。
退的tax: 390 * 1.1% = 4290全年, 2145半年,1072三个月
怎么都算不出来29xx和调整的3xx
我的问题:
1)san jose property tax 税率多少?怎么算出来29xx的?

1.买的builder的新房,4月closing。1月1日时房子还刚开工不久。
2 lender要求property tax必须escort
3.处理title的settlement company会帮忙我跟builder 就第一年的property tax 讨价
还价么?
4. 默认的处理方式是不是tax除以365 双方按天数付?
5 1月1日时房子还没建成,如果closing时 tax是按照land assessment定的价格,
closing之后会收到补税的通知么?我觉得如果closing之后收到补税,就没法找
builder再要了。

没有agent 我自己查了一下
因为马里兰的property tax fiscal year是6/30 到7/1, 每年五月的时候assessment
,下一年的property tax。 closing时要付的是2017/7/1-2018/7/1的tax。

只能退回去年所交的700多块的税,没办法拿到1000足。
我的情况:f1, 小孩是2006年在美国生的。W2上的工资是11052,1042S上有近6000块(
包括5000 TAX TREATY的免税额和1000多免税的FELLOWSHIP). 原来不知道child tax
credit,填写的是1040NR-EZ,交了750的税。
重新填写1040NR,发现在第47项的child tax credit 只能填750。child tax credit还
剩余的250只能通过additional child tax credit 8812表来计算。可是8812上填写的
EARNED INCOME 似乎就是1040NR上的第八项,也就是W2上的工资11052,这个低于8812
表上的11750,所以算出来的additional child tax credit 是0。
这也就是说我只能把去年交的750税完全拿回来,不能通过additional child tax
credit 拿回 |

我在看2007年1040instruction的时候,看到36页上有个worksheet看这个纳税人是不是
需要file form 6251,也就是AMT。这个worksheet将那些在itemized deduction里
deduct掉的东西都加了回来,我明白,可是为什么要减掉tax refund?所以我在联想到
1040税表上将当年的tax refund是算作了income,这跟amt是什么直接的联系呢,导致将
其从amt的income里减去?难道就是因为不想double tax? 可是问题又来了,tax
refund其实是由上一年的state and local tax deduction而产生的,而在算今年的amt
时,加回去的是今年的state and local tax, 减的是今年的tax refudn,也就是去年
deduct的state and local tax。这是为什么? |

我去IRS的网站上查了一下关于Estimated Tax,是这么说的:
Who Must Pay Estimated Tax
If you had a tax liability for 2008, you may have to pay estimated tax for
2009.
General Rule
You must pay estimated tax for 2009 if both of the following apply.
You expect to owe at least $1,000 in tax for 2009 after subtracting your
withholding and credits.
You expect your withholding and credits to be less than the smaller of;
90% of the tax to be shown |

l*****e 发帖数: 594 | 43 第一种情况,F2在美逗留不足2个月,转成F1(不论是否回国签证),可以享受Treaty
,可以找payroll office递交8233免除tax withholding。
第二种情况,F2在美逗留超过2个月,转成F2。这个定义比较模糊,主要因为Tax
treaty中没有对residency作明确的定义。对于在美国换签证的,P4152明确说明要在
home country逗留365天才可以;对于回国换签证的,我没找到明文规定. Revenue
Ruling 56-164 和 General Counsel Memorandum 37047, 好像有相关说明,我不是很
确定。但是在中国的 “国际收支统计申报办法 PROCEDURES GOVERNING THE
DECLARATION AND STATISTICS ON INTERNATIONAL RECEIPTS AND PAYMENTS”,Article
3 The term ``Chinese residents'' as referred to in these Procedures

填表要求退还Social Security Tax和Medicare Tax。 federal tax 已经退回来一个
多月了,但是Social Security Tax和Medicare Tax 还没任何消息。 |

Social Security tax and Medica tax。退税的时候,我只把Federal income tax写上
,其他2个没写。按中美协定的Article 19,应该是免税的。我退税金额填Federal
income tax的金额,可IRS来信说Adjusted refund,没给我全额的。请问怎么办,另外
把Social Security tax and Medica tax怎么要回,去IRS要还是去那,要填哪些files

在线填了打印寄,本来没什么事。于是我就去填了,填到tax treaty的时候出现疑问。
网页显示说,根据19条,我的收入是符合条件的,问我是否claim exemption。毫不犹
豫地选择Yes,但接下来的问题让我崩溃
