水平很高。对梁彼得枪走火描述精当，特别是及时采用了 new evidence，即CPR训练不
足是警方训练官的责任。New evidence往往是上诉的最直接有效的理由。可惜这只是针
对次要罪名即渎职罪。
但是看了一下那个犹太律师写的动议，有几点不解。
1， 为什么没有提出2004年白人警官 Neri 在巡逻政府楼时跟梁彼得最相似的被惊吓开
枪走火打死人案子？这个动议关于意外走火一事收集了好几个案例，可是为什么没有这
个案例？这是跟梁彼得案案情最接近的一个案例。如果这样的案例都被疏漏，我相信这
个律师就跟第一个律师一样，是虽然帮忙，但是是有所保留的。有可能是不会想为了梁
彼得得罪主流的。
2. 似乎没有对这个庭训过程的不公提出足够的质疑。比如，其他华人律师以及华人网
友都纷纷指出了，法官不应该允许陪审员试枪。即使是当时梁彼得律师没有反对，也可
以让这个律师承担责任，叫做“没有得到充分的法律辩护代表”，也是上诉的一个有效
理由。其他网友都提出了很有力的论证，梁彼得应该采用。
