现在我租住在一个私人的condo里,跟房东签了lease, 到今年十月才到期。
昨天,房东突然告诉我他付不起mortage了,要short sale这个condo. 房东还说我还可
以接着住,因为short sale 需要银行approve, will take 6 months or longer.
我现在不知道该怎么办。肯定是要找新地方住了。但是我想等到三四月天气暖和了再搬
。
我的问题是:
1.如果房东short sale的话,现在这个房子还是房东的吗,我还要把房租交给他吗?
(理论上是不是房租属于银行?)当然,我肯定会交房租,只是不想被骗。
2.我有$1500 depositi 在房东那里。 房东现在欠银行钱,将来肯定也没钱还我的
deposit。我想通过少交下面两个月的房租把deposit抵 |

short sale里推出来,有经验的筒子们能不能confirm一下,这样是合乎规定的吗?
第二个问题是offer问题,我的agent说如果我们offer太低,可能会被别人outbid。是不是short sale的房子在刚上市不久银行会多等几个offer再做决定,还是受到一个offer后就暂时不接受别的offer了?

?记不清楚了。因为我们刚开始确实没什么概念,只是看着看着才学到点东西。后来就
只找他看regular sale的,short sale的直接跟listing agent联系看房下offer什么的
,因为很明显short sale的找listing agent管用的多。
现在我们找别人看了一个short sale,签了合同,马上要submit到银行了,估计就它了
。我自己觉得我们的buyer agent带我们看了房子,他人也不错,办事也利落,让人家
白忙活一场挺不好意思的。不知道这对agent而言是不是很普遍,大家这种情况下怎么
办的?是不是该封个红包给他,买卖不成仁义在?不知道多少钱比较合适啊? |

。看标准的合同里,对这个日期是这么解释的:
C. “Date of Ratification” means the date of final acceptance in writing of
all the terms of this Contract (not the date of expiration or removal of
any contingencies).
我理解,就是买卖双方签订了合同的日子,不知道对不对?
有的agent就说,即使是short sale,所有contigency是从买卖双方签合同的日子算起
的,不是从银行批准算起。这是标准的合同,没的改等等。
但因为是short sale,有个银行批准的问题,所以有一个"short sale contingency
addendum to sales contract",在这个里面,对时间有这样的定义:

银行批准Short Sale的法律文件以及书面信函。
在对方贷款银行批准Short Sale的法律文件中,明确了Short Sale的建议售价(用了 at or near XXX.XX USD 字样),以及销售期限。而在销售期限中,又根据销售的不同时段,要求Seller支付贷款银行多少多少钱。
而在对方贷款银行给Seller的书面信函中,则规定了允许支付的commission fee上限,
以及卖家所要支付的closing fee上限.等等。 |

sale对credit影响小一些,但是我们实在不想多花时间在上面。想知道几个问题:
1.short sale差价要自己给补上还是银行可以forgiven?

不过你所有工作齐全, short sale能成功的可能也只有1/3左右。
要价格非常apealing才值得。 我有一个short sale的房子, 总共花了8个月,
律师, inspection, mortgage application, survey,title search什么都做好了,
花了2000多刀, 结果在close之前的3天, 房东说他们找到一个program帮助short
sale owner的, 说不卖了。
这个时间和金钱花的太冤枉了。
如果能找到REO的, 最好不要碰short sale. |

流快。如果Listing Agent有一定经验,可以与卖方的Lender直接联系,Listing Agent
直接递交Offer给卖方Lender,那么,Short Sale的房子处理起来会快很多。而且,买方通过Listing Agent,也可以在第一时间了解Short Sale的处理进展。

1)inspection费,是你自己请人做的,所以只要你请人做了,不管最后你买不买,你
都要付钱的。
2)签offer的contract要有律师过目,那个也是保护你自己的,所以是事先要请好律师
,然后根据你出的价格等银行的答复,short sale需要银行同意的价格才可以成交。(
但是一般律师接了你的案子,你中途停掉不做的话,应该是你们之间有个协议,就是根
据案子的进度该付多少费用)
我去年也刚经历过short sale过程,所以比较清楚,也是在纽约。
一定要记得要有耐心,short sale比一般的程序慢,但是价格一旦银行同意的话,过程
相当的快了,和一般买卖房子区别不大了。
还要注意的是,short sale的房子破坏程度你自己的要留意,一定要在签交房日前2,3
天去检查下房子。

个人认为foreclosure is not an option.
我对foreclosure和short sale有深入研究
1)对信用度的损失是一样的,因为你有default。如果你没有default,并且short
sale成功的话,那信用度是区别的。但是如果你不default,银行一般是不会同意short
sale的。
2)最重要的一点是银行可以到法院告你,如果是foreclosue的话,你会得到
deficiency judgment,这个东西的时效很长,可达20年,如果你将来有钱的话,你是
要还钱的。short sale一般是没有的。如果你是蓝领,银行可能不会pursue这个,但如
果它认为你将来会有钱的话,它或许会。建议你google deficiency judgement. |

的后果,很可能得不偿失。
2.short sale 没被正式批准以前,给deposit其实也只需要支票的 copy. 不会被兑现
的,即使不给也没差。
3.卖主的银行只管他们自己的审批进度,你写多久都不管用。等批了,你可以决定要不
要。随时可以退出。要注意的是,究竟有几个银行,很多卖主有2-3个贷款,要得到
一致的同意,需时较久,而且很可能批不下来,最终被 foreclose.

房主没好好维护房子。要修的东西很多。维修费(A/C, Dishwasher, Roof, Ceiling,
etc)大约要13k-15k。
这是不是说 Regular Sale 市场 fair price 应在 175k-180k 左右?
很多人说 Short Sale 价格通常应为 Regular Sale价格的10%-20% (Some people use
the range 10%-15%)。
这是不是说 合理的Short Sale价格 could be as low as 175k*(1-15%)=148.75k?

据说房主一家都跑了,现在房子是由一家trustee在接管,房子没有disclosure等资料。

网上写shortsale,电话问又说是已经brankcrupcy。这种情况的房子正常么?不知道
到底是short sale还是bankrupcy?
2:据说该房子的title是干净的。listing agent那边建议我们如果有疑问可以打电话

答应了我的offer,现在在做paperwork,这周应该就能拿到approve letter.
但是周围小区的房子无论是正常卖的,还是short sale 的,都基本砍了3万下来,我们
只砍了1万8. 房子基本条件都不错,就是seller 要把所有的电器都搬走,我们想了想
厨房电气也就2000-3000.但是因为short sale 是 sold as is, 如果inspection 检查
出小问题我们自己出钱修就算了,如果问题太大,也可以walk away. 就怕一些不大不
小的问题,我们自己要拿钱修就太多了。
想请问一下大家,short sale 一般比正常卖的房子,买家会多出哪些费用?这样心里
好有个底。

takes longer. Two comments here:
1. It's really up to the bank(s) (possibly more than one).
2. The LISTING agent is really critical in terms of moving the sale
through. It can easily fall through b/c the agent does not know what he
is doing.
My suggestion is to find a failed short sale which has been through most
of the process. It saves you a lot of time.

for the inspection: if you do it before your received approval from the lien
holders, you can actually know 1) whether to wait for the approval or move
on since short sale will be an "as is" sale. There's no credit for repairing

不知道,我是看着房子的condition不错,location不错,就下offer了,同时还在找房

v***w 发帖数: 339 | 49 看房才两月,看了七八个吧,最近看的一个short sale的sf, list price $495k
看房里的装潢像是样板房,新房时候的价格比旁边的房子贵了六七万。
周围房子差不多的也在49万上下
我们的agent当时说这个价格很不错,房子的condition也可以,就让我们offer $495k,
然后跟seller要$5k closing cost.
我们后来出$49k,要$5k closing cost. 开始listing agent说有几个offer,问我们愿不
愿意加,我们还挺喜欢这个房子,就想加5k. 我们的agent听说我们想加表示有点惊讶
,不过也没阻拦,最后我们觉得对方在诈我们,就还是没有加价。
后来签了contract, 给了agent一个copy of $10k check.offer就递上去了,没想到不
出两周银行就approve了。
有几个疑问
这房子我们出价是不是高了?版上说short sale 一般可以便宜10%?这个房主05年高峰
时候花$630k买的,三年前就搬出了,这房子后面都是出租。
第一次买房,又是买的short sale, 有点怕怕的

Short Sale时抓差做参谋了,我自己买的时候没有太大的故事,但是我朋友遇到的故事
就比较有意思了。
第一个朋友去年从递Offer到下来花了6个月,直接找的Listing Agent (我也是这么做
的)。一个Lender, 回来加了2万,算算还行就接受了。Escrow结束前去最后Walk
through,我也去了,发现厨房的柜子全没了,这个晕啊,转了半天,结果发现在车库里
面有3个绑好的托盘,上面是柜子。原来的房主是棒子,这个猛啊。还好还来不及搬走
,不过也额外花了几百块钱找人装了回去。
上月一个朋友也递了一个short sale的 offer,也是直接找的Listing Agent 。2个
lender,第一个原来是BOA,递进去后被告知loan被卖给一家投资公司了。本来还有些担
心,没想到不到一个月就下来了。没有加价,还给了2nd lender 6000,这样最后比市
场价低了20万,只是要求15天结束Escrow,几乎不敢相信如此顺利。昨天我一起去walk
