仔细看了一下有个问题：Have you ever applied for permanent residence before?
这个问题律师说只有以前提交过485才天yes,是这样吗？
我觉得这个地方应该写yes,然后注明以前140的信息对吗？ |

月了，马上要file EB2140 and 同时recapture 之前PD date.
我的问题：是不是可以直接请公司file EB3（10月就 current了)，同时提交485，
recapture之前的PD. 这样做是不是可以操作办法，可以最快拿卡？有什么风险吗？比
如如果eb3突然倒退，我不能回到EB2……

我在填写485的时候发现要一个140的receipt number。 我的NIW 140 的PD在approval
notice 没有recapture以前的pd，所有还没有current。 那我这一栏里要甜老的
receipt number 以及PD， 然后写信recapture这个pd，还是要用NIW的140 number？

link 他的case到eb3 track？
楼主要交表，如果eb2排期没到你的话，又想下月交表，那就只好像我们之前说的那样
，说清楚eb3 pd为何被搞错了，并要求他们recapture。还要求link到eb3 track。
485里面都是要按照eb3的case的信息来填。J表也是。
由于你是单独提交485，所以需要J表一起附上，如果可以开的话。 |

地部分不可以折旧.
Subject to AMT, 出租房折旧可以抵当年的收入税，但是卖出时整个折旧部分要一次性
补税回来，这个叫 recapture。 一般来说买进出租房的时候，年纪轻，收入高，税率
也高，卖出的时候，也许退休了，收入比较低，税率也低，但是也有卖出的时候个人税
率比卖进高的时候， 那就不划算了。那这样的话， 干脆出租房不申请房屋折旧好了，
也省得将来卖的时候要补税。 不行！IRS一定要你折旧， 你不折旧， 卖的时候， 还
是要recapture， IRS 来帮你算要补多少。
所以，大部分地主们都是做 1031 exchange. 就是说在卖掉出租房的时候， 马上再买
进另一个价位更高的不动产。 |

Congressman Conyers 突然宣布休会，导致包括recapture在内的三个移民法案没有被
表决。据lobbyist透露，在座的很多议员，包括移民委员会主席Lofgren都对Conyers的
决定感到意外。本周四，委员会全体成员将进行休会前的年度合影，而recapture再次
被排上mark up日程的希望渺茫。
Conyers的决定可能是受到了目前金融危机和迫在眉睫的financial bail out 法案的影

关于你说的 depreciation deduction，我非常确定以后卖房子的时候是算 ordinary
income 了。
开始买出租房５０万。卖６０万。
如果有２０万的 depreciation deduction，就要对２０万收 ordinary income tax
rate。
我听说过好多老中卖出租房因为税收赔钱的故事。
