鉴于2007-2009年监察任务完成的不理想，以及国内整体教育投入的改变，基金会于
2009年加大了监察工作投入力度，明确了监察组的职责范围不仅仅局限于图书监察和助
学金监察。为了确保监察质量，提高监察效率，监察组于2009年9月开始聘用一位OCEF
义工作为专职监察员，主要负责走访高中奖学金项目和代课教师项目的资助点。同时监
察组2009年继续广泛地招募临时性监察员走访基金会的助学资助点和图书捐助点。
其中高中奖学金点几乎全部由专职监察员走访完成，共进行了6省10县市12所学校183名
学生的监察工作。

与往年相比，2009年的监察在质量方面有了比较大的突破，及时发现上报了一批有问题
的资助点，减少了基金会的损失。这样的结果一方面是因为有专职监察员的参与，另一

今天，我在某网站看到一则消息《李洪志在美国认罪（图）》，称：2006年2月27日，
李 洪志因驾车未系安全带而受到犯罪指控。桉件由美国新墨西哥州法院开庭审理，随
后，由于李洪 志未按时出庭，受到了第2项指控。2006年4月17日，李洪志签署了认罪
书，并支付了罚款，承担诉讼费用。并称，曾经李 洪 志2008年6月因交通犯罪在美国
受罚的记录，那次李 洪 志因超速在美国弗吉尼亚州史密斯县地区法院受罚。
对此，我这就纳闷了这个自称“法力比释迦牟尼要高几百倍、几万倍”，甚至还自吹
“我的根都扎在宇宙上，谁能动得了你，我就能动得了你”的神通广大、无所不能“宇
宙主佛”怎么居然就斗不过这些凡人的交通警察和法院法官呢？还向他们乖乖的低头认

一般去法庭，可以博警察不来，你就直接dismissed。
如果警察来了，就看情况。
如果你有证据，或者有一肚子理由，并且都是valid理由，那么就plead not guilty.
然后可能会另选时间开庭。你可以找律师，律师费当然鸟贵。你也可以自己申诉。按照
你前面说明的情况，你可以强调在当时的情况下，停车反而危险。紧急刹车会导致你脑
震荡什么的。法官不会因为你plead not guilty而多判。
如果你觉得自己口才不够好，法律知识又不太懂，那么就no contest或者plead guilty
with explanation. 当然，开庭之前，你应该可以有机会找prosecutor谈一下。各法
庭不同，不过你可以bargain一个合理的结果，目的就是不扣分，罚款也就算了。如果
又要扣分又要罚款的，就不要接受bargain，plead not guilty.
有的法庭开庭前会给你机会找prosecutor谈，有的是要等法官叫你名字了，你再去谈，
反正你一定要早早地去，提早1个小时去，最好你的名字被叫到了警察没来，你就赚了。

１４迈你happy不？＂我说happy接受认罪。法庭上的起诉是超１４迈（超１５迈２０迈
分别是两道坎），我plead guilty跟法官说我很后悔很sorry当时粗心没注意速度，今
后一定小心，法官说不记点了，交罚款走人。
你才只是被警察抓住超速１３迈，不算严重，没有必要冒险plead not guilty，去法庭
跟检查官达成plead bargaining，一般检查官会把你的超速再降低一两个档次，最后赚
你一点出庭费和罚款了事。
一个原则，plead not guilty风险很高，赢了你一点事没有，输了你全输。
各州法律和操作程序有所不同，这点你最好先问问本州有经验的。 |
