速度，没有换到里道远离警车。
后来发现警车一直跟在我后面，直到下了95，我停车在路边看地图时，警车开始闪灯。
我礼貌解释我没有来得及换道，但警察似乎已经打定主意开罚单, $181.
罚单给了两个选择：1.交钱认罚，2. plead not guilty 出庭。
个人觉得有点冤枉，想争取一下。但我人在南部，无法出庭。有没有人plead not
guilty 但是通过书面陈述呢？

Written Declaration。很容易。不用用他们的服务。警察不回答的机率很大；所以写
什么没有很大关系。如果Trial by Written Declaration输了，可以再上庭争。可以向
法官要求traffic school。
当然是plead not guilty。如果plead guilty了，就是认罪了。

可能超车的瞬间达到过88, 这种在很多州基本不会抓的），当时警察也没有当场给
ticket, 说会寄到家里。几个星期后收到一个两百多的ticket, 问是否plead guilty,
因为我当时在麻州，离开庭的town有四个多小时车程， 就想算了，认罪付ticket了事
。没想到一个月后，又寄来一张bill, 说是积了六分要补罚$300,而且因为已经plead
guilty所以根本没机会argue. 这是我见过最狗血的事了，这州政府得穷成什么样子才
做得出这种恶心事情，后来上网一查有很多人被这招阴过，基本都是外州车辆。所以你

情况是这样。
拐进一条只能是校车的路，罚款９０，扣一点。当时确实是没有看见标识牌。
后来回到现场发现（丁字路口），拐弯处的标识牌不是对着驾驶方向，而是和驾驶方向
平行，对着丁字路口的房子（拐进去的路和房子垂直）。只有拐弯的时候，有意识向右
上方看，才有可能看见。实际上非常困难，因为车右侧非常靠近标识杆。
上庭的目的想打掉点数。
我的情况 plead “no contest”， 可行吗？

那天比较点儿背。下班路上有一个路口要左转，左转lane比较短，一般都会被直行车堵
住。我那天有些心急，看对面车道没车，就穿过去上了左转道，结果一过去就看见警车
在对面，就悲剧了。
罚了100多块，不知道是应该直接交了罚款不上庭呢，还是要上庭？应该是没有什么理
由开脱，的确是穿到对面车道了。关键是上庭对记录有没有帮助，能否请求不要留记录
？还有，上庭要不要多交钱？另外，我看见有人说去法庭的时候，要说”plead guilty
" or "plead not guilty",我这种情况应该选哪个？

speeding(50/70)，use phone, failure to yield emerging car(警察说他让我pull
over，我过了一个街口才停). 当时在高速上，旁边是草地，我看到他，打右灯，第一
个路口就右拐停下了。
这个警察把3个罚单开到了3个不同的courts, 请教大家这种情况要怎么办？警察这么做
，对么？
我已经把plead not guilty的信，邮到了3个courts, 只有一个speading的court回信了
安排了调解日期。其他两个都没回复，要怎么联系他们一下么？还是等就行？
罚单是7月18开的，他们收到plead not guilty是7月25，收到speading的court回信是8
月8。感觉两个courts的回信好慢啊，不知道是不是邮件没收到。。。 |

半年前的车祸，左转被直行teenager撞，两年新的车被total，人没啥大事儿。当时警
察给了我“failure to yield turning left”的ticket，要求上庭。十五年的老司机
头一次车祸拿罚单，头一次坐消防车去医院。上庭那天对方在父母及律师的陪同下到场
，还有第三方witness。（我的车尾被撞后转了几圈蹭到了在路口的第三方的车）。公
诉人告诉我可以给我三个月supervision但要plead guilty.我说我要请律师，然后法官
就宣布一个月后我请好律师再来，但对方和第三方第二次不需到庭。一个月后约好了律
师再次出庭，律师说我赢的机会不大，两个方案，plead guilty加三个月supervision
，或者bench trial赌对方来不了。他建议bench trial。我其实当时已经被这个事情弄
得很烦了，很想早点结束了事，但既然律师建议trial那我就听律师的话吧。两个月后
，也就是今天是上庭的日子，对方居然没有来。:-)

，可以邮寄或者直接去当地的office。如果打算上庭的话，就一定是要plead not

好的开始。我相信，ebiz围观群众都乐观其成。至于行会的这一举动是按行会自己原来

美国食品暨药物管理局(FDA)前华裔化学家梁诚一(Cheng Yi Liang，音译)，因屡次利用与职务有关的非公开资料从事内线交易，5日获判五年徒刑。他从内线交易获得的380万元非法利益也被下令没收。
助理司法部长布鲁尔(Lanny Breuer)说：「梁诚一利用在FDA担任化学家接触的敏感内线资料，从制药业股票市场获得不法利益。他多年来利用在FDA的职务在股市轻易赚钱，可是今天的判刑显示这种做法的后果。」

非法报销。我知道一个非中国牛人就是先quote一个price, 买票时价格更低，
然后人拿quote的price去报销，后来因为得罪了学校的人被学校查出几百元差价，
在办公司直接被警察手铐带走。学校说如果他不plead guilty, 就好要接着
往下查，数目可能就大了。然后他plead guilty, 以离开学校换取不被学校起诉。
这么多年过去了，那人到现在还没找到工作。
两边通吃的胆子大得很，不是你我能想象的。我几年前就听说过N多千人违规
拿钱的事了，当时和几个朋友讨论时都认为很多千人要出问题。那几个朋友
本来还在国内学校暑假干1，2个月，后来都全职美国了。只有我们想不到，

“13年来，我和那些为潘伟平工作的中国大陆学者成为了亲密的朋友。多年来我一直知
道，他们长期超时工作。对此，我选择了‘听之任之’，因为我不想找麻烦。今天，我
为自己未能帮助那些无助的人们深感愧疚。他们无助，要么是因为文化原因，要么是恐
惧，担心引起潘的不满和报复。”
“我必须承认，我为那位煤炭研究主任（潘伟平）赤裸裸的剥削深感不安。同时我又不
愿意我的这种不安给他带来任何伤害。我不能这样做，因为这有悖于我的做人原则。我
只是真诚希望所有那些深陷困境的人（大陆学者）会得到同情和公正的对待。”

美国FDA华裔化学家因内线交易被判刑 罚没380万非法利益
美国食品暨药物管理局(FDA)前华裔化学家梁诚一(Cheng Yi Liang，音译)，因屡
次利用与职务有关的非公开资料从事内线交易，5日获判五年徒刑。他从内线交易获得
的380万元非法利益也被下令没收。
助理司法部长布鲁尔(Lanny Breuer)说：「梁诚一利用在FDA担任化学家接触的敏
感内线资料，从制药业股票市场获得不法利益。他多年来利用在FDA的职务在股市轻易
赚钱，可是今天的判刑显示这种做法的后果。」
卫生福利部督察长办公室特别探员马隆(Elton Malone)说：「梁某利用敏感的内线
资料大胆谋利。他不知道调查人员早就利用先进科技工具发掘和追踪犯罪行为。我们将
继续坚持联邦员工遵守最高标准。」
58岁的梁诚一去年10月18日承认触犯一款证券诈欺罪和一款提供不实证词的罪名，
