发帖数: 2113 | 5 作為臭名昭著的紐約人我得承認確實不瞭解其他州到底在幹什麼。
去年高院推翻DOMA第三條之後，排山倒海的架勢其實是可以預料的。
高院的判決對聯邦巡迴法院的案子有管轄效力【中文是這麼說的嘛？】，
這之後凡是在聯邦巡迴法院關於同性婚姻的案件，
都得援引高院的Windsor判決。
所以一個一個州的攻克是可以預見的，
只要某個州的same sex marriage ban在聯邦巡迴法院受到挑戰，
結局基本就是輸，然後吶，像Utah 一樣再通過行政程序block，
再繼續對壘，堅持不了多久，也遲早會被推翻了。
某種意義上來說，確實是保守派受不了的一種趨勢，
五個大法官戰勝其餘四個，
然後全國的聯邦巡迴法院都效法，
也就相當於幾個法官成了法律的主宰。
不過有啥辦法呢，遊戲的規則就是這樣定的，
想當初異族間的通婚也是因為Loving v. VA 的判決，
在全國個個州逐漸推倒藩籬的。
網絡時代自由派盛行天下的時代，
進程只會更快。

。近几年由于高就业率吸引了更多蓝州的居民，所以民主自由化的倾向更甚。A

德州二月的聯邦法院審理結果不會有意外。
問題就是州政府可能行駛行政權力阻止發放結婚證。
這個拉鋸我個人覺得高院不見得願意涉足啊，

记得United States v. Windsor 10年开始起诉，13年高院判决下达，历时不过3年。按
照这个进度，以Utha为代表的这些起诉same-sex marriage bans的cases，2年以内高院
一定得判啊。我以为高院早晚得受理，目前纠结的只是时间问题。
但听你的意思是说，高院因为DOMA第2条而不愿意涉足，如果压根不受理，那么我们红
州的这些官司岂不是白打了？而且联邦法庭的判决迟迟不能执行，司法的公信力何在？
如果司法不能解决问题，依靠公投和议会表决去推动，咱西部大农村更不知道要等到猴
年马月才能吃上饺子了！555555555555 |

巡回法院判决据三叶虫说又是稳拿胜算。
那么也就是说上诉判完了以后utah的同婚就算结案了。

我寫了一堆全沒了，老邢就不能修改一下cache嘛。

爲了回答你的問題我重新research 了一下，
Utah案件在第十巡迴法院碰上了個激進的法官，
法官是Obama任命的，然後呢，猶他州的民主黨參議員是個公開的同志，
DOMA 被推翻那天求的婚，
巡迴法院的判決下達之後立馬就去結了婚，而且是市長證婚。
這件事情在政治上一定有民主黨和共和黨的角力。
法官的判決說Utah州的州憲法禁止同志結婚違憲。
這對那些有類似州憲法的保守州是一記大耳光。
畢竟大聯邦主義和州法自治權是永不調和的矛盾，
高院在處理州憲法是否違憲的問題上會很小心，
可能會觀望有沒有別的保守州發生類似的上訴案，
然後來個集中審理。
Windsor 案很幸運，因為排在前面的麻州案排了很久的隊，
麻州的案子是最有可能被高院審理的，
但因為Kagan 在成為大法官之前曾涉足麻州的案子，
為避嫌選擇了Windsor案立標杆。
所以說不是Windsor夠快，是趕巧。
高院什麽時候能就州憲法禁止同性婚姻做出判決，
我覺得速度應該快不了。
不過呢，可能保守州的州憲法被多幾個巡迴法院宣佈違憲，
高院就不得不考慮審理。

當然當然，在美國歷史上，VA絕對是比紐約更重要的州，
無論是立國還是後來的內戰，
VA在協調南北分歧上，起的是巨大作用。
VA 盛產政治人物，從撰寫獨立宣言的 Jefferson 到 內戰的General Lee。
如果說紐約，麻州的東北部向來代表激進自由主義的話，
VA 則真正是美國文化的風向標。它成為紫色是自然而然滴。
VA 的案件極可能帶領一些保守的州倒向同志婚姻平權。

人走茶凉可能就是这样吧。他不存在，久而久之，我再努力也感受不到他的存在。他于
是对我而言真的不存在了。

记得他刚离开这个世界的时候，我几乎两天没吃东西；不知道从什么时候又回到以前经
常惦记吃也享受吃的状态了。
记得他刚走的两天，我整天象个zombie一样晃来晃去，不知道周遭发生了什么事，甚至
见过好几次的人都不记得见过；现在居然记得今天哪个店要打折了。
还记得他说他是真的鄙视我，记得我说此生最厌恶他，还记得我们之间的每次争吵，但
