he got laid-off, the I140 immigration intent is gone with the termination
of employment.
So F1/B2 is OK. I asked my lawyer for that matter. |

invoke or not). BUT, your PD is kept and you can retrace it with new I140.
You have immigration intent with I140 with the current employer, that's it.
Our company has very good lawyer and that what they explained to me. However
, there always chance of rejection no matter what.
There are all sorts of rumor/misunderstanding about this H1B/I140 stuff, no
all information you heard are credible.

away, then he can apply F1/B2 (not necessarily approved, of course), and
once he finds another job and does his H1B transfer later, his PD is still
kept?
I am more interested in the last part. If PD can still be kept even after
you have applied for another non-immigrant visa type such as F1/B2, that
would be beneficial. Otherwise I'd rather have 1-2 months gap before the
next H1B transfer.

不过我们讨论的关键是到底140是不是随着termination自动无效的。如果不是，除非你
去要求公司revoke 140,不然我的理解是140的存在对你在terminate以后申请F1/B2还是
有影响的。
我不知道laid off以后，如果你想用申请F1/B2来争取时间，而且要求原来公司revoke
了140，会不会对你将来找到新工作以后重新file PERM和140有影响（比如140被revoke
了究竟能不能再被relink，这个也是法律上的一个grey area)。另外，如果140在没有
被主动revoke的情况下，F1/B2的申请是否能成功，还是一般会被reject，有了这个记
录，等你找到新工作再file perm和140，甚至在H1B transfer期间，会不会又有新的麻
烦。

is the beneficial ? if the employer breaks his promise and withdraw the
offer after filing, he would have to submit a notice to the USCIS that the
employment is invalid anymore,which means the IO would deny this petition.
Anyway, your wife is still H4 before the H1b issued. Did you wife already start to work in this office ? if yes, that means "laid-off before H1b is approved"..if no, it is H1B transfer pending. |

。今年一月，公司递交了基于PERM的I-485。我于三月已收到EDA卡而且我家LD已开始用
EDA卡工作。
如果我不幸在公司下星期的改组中Laid off，如何把pending I-485和我的NIW联系起来
？可不可以在失业的情况下进行？or just waiting instead of triggering the
possible pre-approved case?

required by law to inform USCIS about my employment termination? If this is
the case, then the chance that I got RFE is very high, right?
2) If I indeed got RFE, will my online status be changed also (now is still
"Acceptance")? I just want to make sure that I will not miss any RFE.

You don't need to wait the approval of 'X'. You can file H1B as long as you
have a job offer.
I got laid off in May. I filed B2 application at the same day (by attorney).
And i got a job 2 weeks later. The company's attorney file the H1B
mentioning that I have B2 pending. But the funny thing is the USCIS approved
my H1B but my B2 was still pending.
So, I think the company's attorney forgot to mention my B2 case in the cover

没有spouse，
各种其他身份（f, h4,b)都转不了
只能继续找position with non profit h1b sponsorship
如果在有限的grace period里面找不到工作，走投无路就要回中国了
1. 请问如果回中国的话，这个PD是否还保留？
2. 如果PD还有效，过几年current的时候，还能递交485吗？
3. 如果还能递交485的话，递交的时候人需要在美国而且有一份工作和当时NIW申请的
领域相关，对吗？但是中间这段没在美国的gap，会不会影响485的批准呢？

去年毕业，现在OPT 9月就到期， 苦逼文科不能延期的专业，刚被通知公司被收购，被
Laidoff 答应再付两个月工资，加第三个月不付工资，但可以保身份到第三个月底。听
说OPT失业后有90 Grace Period. 那请问我是不是在公司失业3个月后还有90天的
GracePeriod。 也就是一共180天还没找到工作就必须换身份？还是从Laid Off那天算
90天的时间必须找到工作可以继续用OPT？
LG的140 刚交，要求了PP，应该近期可以批，所以可以申请H4EAD，最近有几个Onsite
，其中有Dream Company，但如果我近期拿到Offer，是否还可以用OPT先工作，同时提
交在5月底同时提交H4和H4EAD申请， 请问提交了H4 但还没有批准的那段时间，是否可
以用OPT工作？还是一提交H4的申请就不能工作了，必须等到H4EAD批准了才能工作？请
问H4 和H4 EAD的申请一般需要多长时间？

边上班。他们才找人REPLACE ME的。
他们其实也不懂，就是律师跟他们说怎么操作。因为律师是我找的，也知道拿到QUOTA
的不容易，就替我保留QUOTA.

offer,但是记得EB2申请有prevailing wage的要求，问题是找新的工作是否年薪不能低
于以前的工作？如果offer来了但年薪还不如以前高，是否应该接受？主要是担心如果
来了EVL的RFE，是否会要求出示年薪的证明或pay stub之类的材料？
另外如果换一个城市找工作，是否还得根据新的城市对EB2要求的prevailing wage来考
虑接受offer?

，还需要做哪些事情吗？具体问题如下：
1.原来的雇主还算nice,虽然裁了我还算我一直处于休假状态，没有取消我的H1B，现在
去新雇主那里如果用EAD工作的话原来的H1B就自动失效了是吗？
2.目前485还在pending, 原雇主也没有把我被裁的事情告诉公司律师，现在我去新雇主
那里需要cancel掉以前的律师吗？这个我不知道有什么影响，只是之前看到板上有的朋
友提到要这么做。

是必须是正式的full time employee 还是可以做临时的contractor？
还有一个地方说他们不能sponsor我的H1B，我问那用AOS-EAD呢，他们接着说也不能继
续支持我的AOS，所以直接拒。我有点晕，AOS还需要什么支持吗？请问一下：在绿卡这
个事情上，不清楚接下来还需要新公司做什么事情？也不清楚是不是需要有个长期的工
作合同？
google了半天，可能是关键词不对，没有找到相关的经验。现在一塌糊涂。

As of the 'out of status' issue, i personally don't think it applies to you as
even though a laid off occurred, you got your 2nd job within 1 month and your
successful H-1B transferring also proved you were not 'out of status';
otherwise they would not issue you a transferring. This is my personal idea
for your reference.

最先觉得要解决的就是健康保险问题， 公司给了COBRA， 简直觉得是荒唐， single
plan, just for medical need $480/month. 都喝西北风了，谁还有钱交这么贵的保
险啊， 真心不知道这个plan设计出来是为什么的，也不知什么样的高富帅会选择这样
的plan.
于是果断拒绝了。 后来申请了MassHealth, 小弟有绿卡，估计挣的那点钱也满足低保
收入了， 12号网上申的，14 号就获批了， Mail给了ID 说是Masshealth limited, 有
些什么的还可以再去找 Health Safety Newwork cover.
现在问题来了， 我这算是有health insurance coverage 了么？不用再为这个担心了
吧？ 我平时身体还行， 白交了若干年医疗保险也没去看过，这个plan只要能满足我被
cover就谢天谢地了。
年底了， 最近也没心情找工作了， UI Cover着就先养精蓄锐半年再说吧。 提前谢谢

我们终于越过了这一步,没想到是飓风Sandy带来了这个消息.就像当年考完GRE,申请出

anywhere. I'm sure my company is paying that for me. You will need to check
other resources to confirm.
If you do have unemployment benefit, you will have to apply jobs certain
times a week to meet this requirement.
