这个是骗人的。美国是个商业社会，什么都可以negotiate，连justice也可以讨价还价
。speeding
罚单可以变成parking罚单，蓄意谋杀可以变成过失杀人甚至防卫过当，和检察官讨价
还价，认小罪换取大罪不起诉更是家常便饭，前段时间那个家里监禁性奴的就是个绝好
的例子。
Justice delayed is justice denied绝对是骗人的。换成Some justice is better
than
no justice比较妥当。 |

会山背面的联邦最高法院。其实阿利托大法官的前法官助理朋友已经通过阿利托大法官
办公室给我预订了座位，我本可以九点再到最高法院大楼的，但是一帮同去的朋友还需
要提早去最高法院门口排队拿票，我也很有兴趣了解最高法院的旁听程序就和大家一起
同行了。
城市仿佛还未苏醒，我们的车子沿着静静的宪法路，开过林肯纪念堂和华盛顿纪念碑，
左手灯火阑珊之处白宫南草坪朦胧可见，右边则是灯火辉煌的国会山庄。司机和我们唠
唠叨叨地说今天很可能人不多，他显然常送客人去最高法院，华盛顿的司机和北京出租
车司机一样充满了“政治敏感”，对今天哪里有什么活动，哪里可能会封路了如指掌。

孩子未来的家长--现在就可以花一分钟时间来帮助孩子共同抵抗歧视，增大孩子上他们

应，后者是秩序；前者是不放过一个坏人，后者是不冤枉一个好人。
实践上是在两者间 tradeoff，而且经常波动。不过历史趋势是从更侧重 retributive
justice 慢慢过渡到更侧重 procedural justice。相比而言，中国更偏向前者，美国
更偏向后者。
从文化上来讲，无论是中国传统的因果报应和轮回理论，还是西方的死后审判，都有利
于民众接受程序正义 -- 因为在这些理论下，坏人哪怕现在得不到惩罚，也不可能逃脱
最终的惩罚；可是冤枉好人本身就是罪恶。
而一个缺乏信仰的世俗国家，大家更重视的是前者，否则无法维持社会秩序。这种情况
下，惩罚本身远比正义重要：任何坏的结果，一定要有人来负责，否则民众会不安。比
如倒霉的皇帝，天灾要发罪己诏。再比如苏联红军在国内战争时期的报复政策：如果有
村子帮助白军，红军就会烧毁一个村子 -- 而不必是助敌的村子。甚至有时故意惩罚不
相干的村子 -- 这样反而更有震慑力。美国的很多策略也是如此：故意“误炸”来制造
