联邦政府是否有权利对个人进行罚款，如果他们不交医保的话？ 是否该法案违宪了？
在第一个论点是 INTERSTATE COMMERCE CLAUSE上， 法院认为是该法案是违宪的， 因
为这个条款是只对作为可以进行处罚，而不能对不作为作出处罚， 扩大了联邦政府的
权利，从而违宪了。
很多新闻媒体看了这一部分就跑去发新闻稿了。结果搞错了。
第二个论点是如果该罚款是一种税的话，联邦是有权征税的。 最后有5位法官同意了该
观点，该法案得以保留。
其中ROBERTS这个大法官，本来是保守派的布什任命的， 按常理应该是投反对的，不知
道为什么跳票了，让人大跌眼镜。 肯尼迪这个摇摆票大王却没投赞成票。
继O'CONNOR 法官这个摇摆票退休以来，看来现在ROBERTS接过她的衣钵了。 |

mainland. For instance, some kids from mainland are in student leadership
positions and gain some experience already while ABC's don't have these
