1、移民法明文规定只有移民签证在＂immidiately available＂时，才能接收AOS申请
。在9月6日发布的排期中，DHS认为有些类别的排期不符合＂immediately available＂
的法律规定，所以DHS要求DOS修改。
2、原告没有证据表明因为改排期，会受到不可弥补的伤害。即使有各别人确实有证据
表明受到了不可弥补的伤害，那法院也应该只针对这个人要求DHS接收AOS申请，而不是
针对所有参与集体诉讼的人。
3、原告有可能败诉。如果现在强迫DHS接收这些申请，之后如果政府赢了官司又要退申
请，会对政府有严重伤害并产生巨大的费用。
4、排期是按照已知数据做的最佳估计，但有时这种估计会不准。政府有权纠正VB中的
错误，而错误的VB不应产生强制性的法律效力。
5、不应产生强制恢复错误的VB的先例，不然的话有可能强迫政府违法（移民法）。
看来有人打官司，政府也不会马上让步，而是摆出要把官司打到底的样子。这案子要是
拖个一年半载的，估计原告就自己撤诉了。

see the transfer is not only depend on the banks, also depend on accounts.
For example, I have two friends use NAB, no perticular close relationship
with anyone. it took 2 days for my transfer to show in one guy's account,
but almost immidiately to another one. Similar things happened during
transfer with other banks, sometime took 2 days,over weekend, sometime just
immidiately.
You plan won't work. |
