Forgery的定义,是制造假文件,本身不一定算犯罪(比如造小孩玩的假钞).而把假文件当
真的使用确实是犯罪,至少在美国加拿大是这样.
在中国,刑法里也有伪造证件罪.不过如果没有"伪造公司、企业、事业单位、人民团体
的印章"好像就没事.
第二百七十九条 冒充国家机关工作人员招摇撞骗的，处三年以下有期徒刑、拘役
、管制或者剥夺政治权利；情节严重的，处三年以上十年以下有期徒刑。
冒充人民警察招摇撞骗的，依照前款的规定从重处罚。
第二百八十条 伪造、变造、买卖或者盗窃、抢夺、毁灭国家机关的公文、证件、
印章的，处三年以下有期徒刑、拘役、管制或者剥夺政治权利；情节严重的，处三年以
上十年以下有期徒刑。
伪造公司、企业、事业单位、人民团体的印章的，处三年以下有期徒刑、拘役、管
制或者剥夺政治权利。
伪造、变造居民身份证的，处三年以下有期徒刑、拘役、管制或者剥夺政治权利；

real threat.
2 Investigator Dave Savini reports these bogus licenses are being produced
overseas and sold online.
State and federal officials say they want to shut down the sales of them.
Bogus licenses are seized by U.S. Customs and Border Protection officials in
big numbers, says Chief Customs Officer Brian Bell.

控，警方强调，由于这批疑来自芝加哥南区的假钞，仍未找出真正来源，并且发现这批
假钞，被频繁使用于支付送外卖餐费，其中不少是中餐馆，坊间商家、尤其是外卖郎应
提高警觉。
厄巴纳警局表示，这批来源不明的假钞，近来在当地商家、餐厅“泛滥”，假钞面值从
20元（美元，下同）、50元到100元都有，其中被用在支付外卖郎送餐费比率最多，很
多中餐外卖郎“中招”。多家中餐馆近日都将警局发出的通知张贴告知员工。
在芝城南区送外卖的蒋翊22日向记者表示，最近芝加哥地区假钞的确不明原因增加，他
日前送外卖到芝加哥南区80多街一处公寓住宅时，两名非裔顾客拿出百元大钞付款，但
他发现纸质不对，表示拒收后，对方恼羞成怒，威胁他“一定要收”，当时他担心自身
安危，只好自认倒霉收下假钞，“等于变相抢劫”，蒋翊气愤又无奈地表示。

都没有呢？因为美国人法律意识强——法律意识强不代表美国人都不犯罪，而是因为人
人都知道犯罪成本高，心有害怕，不敢违法乱纪。
一、 城堡法
加州有一个“城堡法”（Castle Law）又称“不退让法”（Stand Your Ground Laws）
。在加州，当受害人感到自己或家人的生命安全遭受了即刻的威胁时，即使本可以逃跑
，却仍可以选择留在犯罪现场，运用适当的武力来进行自卫，甚至可以继续追击罪犯直
至危险解除。也就是说，人们进行正当防卫前没有义务退让或者撤退（No Duty to
Retreat）。
举个例子，甲乙两人作为邻居，邻里关系不好。有一天，乙举着修剪灌木的大剪刀闯进
甲的家中，大吵大闹，称甲他们家的狗在经常在自己家的草坪上“方便”，边说还边挥
着剪刀，吓的甲家小孩大哭。甲要求乙立刻离开自己家中，但是乙不依不饶，还扬起剪
刀冲向甲的家人做剪东西的姿态——此时，甲没有和家人离开自己家，而是从客厅柜子

policy forgeries, certain building permit violations, additional access
coverage, additional protection against prior violations of CC&R's among
many other increased protection coverages. 如果要加这些coverage的话，要多收
10%的费用。
