我和老公去年就是这种情况，我在state A 工作了9个月，然后搬到state B,之后没有
收入.他一直都在state B，只有state B的收入。我们都是F1, 想一起报federal as
resident,（因为他是resident），用state B的地址。
但我在state B只呆了三个月，如果因为和他一起报federal导致我的收入也要交state
B州税的话，实在是亏大了。要是能分开报州税，就划算很多。
但有一点不明：

有娃一个。
federal还是joint退的税多些。
看了看各个州关于filing status的规定，都不一样。
NJ: 要求要与federal一致，但是由于LD全年都不是NJ的resident，所以也可以
deparately。
VA: 因为我没有VA的收入，所以必须separately。
CA: 必须与federal一致，给出的两个条件我只满足第二个，但不知道人家是不是要求
两个都要满足。
我可否先按joint用TurboTax把federal, NJ和CA的填了。
然后LD按married file separately + 1 dependent填Feferal + VA，这个federal没啥
用出，只要最后的VA的税表。
这样是不是就行了？没有漏税吧？ |

I e-filed the Federal tax yesterday (turbo tax), but did not claim the $5000
. I was in OPT from Jan to Aug 2009, and H-1B from Sep to Dec 2009. Turbo
Tax result said I owned $369 Federal Tax. But if my wages minus $5000,
Federal Goverment should give me $340. My question is:
1. Should I file another Federal Tax? /Can I cancel the one I already e-
filed?
2. What should I do if I need to file another Federal Tax? Can I still use
Turbo Tax and just attach 1040-NR and 8833?

我觉得原因是因为我把W2 和 1099-INT 上面的federal tax withholding 加在一起然
后填在
1040表的第61行作为我总共交的federal tax。
但是这个efile（我用的是IRS提供的 Free File Fillable Forms
https://www.freefilefillableforms.com/FFA/Gateway.htm）似乎没有地方可以添加
1099-INT 表， 所以IRS只看W2就发现总共的tax withheld和我填的不一样。

35岁的年纪打入决赛，佩服佩服！Federer说：“he is the only living legend in
tennis”，的确不错。偶家GG说，娶个好老婆对一个男人的事业有多重要，从Agassi身上
看的最清楚了，哈哈；转播在Agassi打了好球和输了好球，都给格拉夫大大的特写。不过
今年好像他们的可爱儿子没有在现场；那个金发小鬼好可爱！
比赛基本上没有悬念，除了第二场Federer反手失误太多，2比6输掉了；第三场开局
Federer打得也不顺，还是unforced error太多，上来就被 Agassi破发一局，其实我当时
好担心啊，觉得这个老怪Agassi不会撞对了风水（现场观众好夸张，我怕影响GG睡觉调的
声音特别小都可以感觉出来“压力”），真的要在今天创造历史了吧；而且Federer最拿
手的反手削球总是出界，吓死人了！

Treaty报税。07年九月后在一个小学校教书是Tenure Track Position。08年7月开始用
H1B工作。但是在07年和08年两年，现在教书的学校都没给我扣Federal 税。说是用
Publication 901 Treaty ：temporarily visiting teachers and professors前三年
不用扣Federal。我不知道我是否符合要求。我怕我们学校HR的人搞错了。我别的同学
跟我一样毕业后也是在学校工作但是却扣Federal了。请大家指教一下。我是否该补交

我老公今年从F2转成J1后，即将收到头两张paycheck
但发现被扣了Federal tax
(另外被扣的social 和 medicare税已说明以后不会再扣，但已经processed的check估
计需要明年报税才能拿回来)
学校payroll认为he is subject to Federal tax，因为他以F2过来，回国转J1呆了不
到180天。
我看精华区知道F2在美国转F1是不能免Federal tax的，但不知道回国转的J1也是这样
。请大家指点一下^^
另外，Federal tax的税率会随着amount而变化么？
Feb 半个月被扣的税是12％
March被扣的税是15％

if you are claiming exempt from federal withholding, you are required to
file a new W-4 form by feberary 15,2011
这是什么意思啊？我的每月工资单里都扣了federal tax，为什么W-2上面没有？？、
