问题吧。刚粗粗看了10个victim的报告，01后有2个。都不是在football program faci
lity.
我个人的看法是，PSU的领导们从来也没有过直接证据（监控录像什么的），但是有人有
accusation, 作为领导，怎么处理是很棘手的。要保护的是PSU的reputation, 也是很多
其他无辜师生的welfare. 广告赞助都停了，那学生福利当然就要影响。反正也没有一击
必杀的证据，就和sandusky达成协议，让他退休，以后不再犯（起码不要和我有关系，
毕竟我不可能天天跟踪你，也不是我的责任，再犯就是警察的责任了)

补充一点：既然法律动用了，NCAA这种业余玩意最好一边站站。你要罚轻了吧，人家说
你把强奸犯和卖两件运动裤搞两个免费Tatoo罚一样。罚重了，真要办PSU football 50
年也不现实。最好让刑事民事法院搞搞清楚。
另外，讨论这事什么意见都欢迎。牵扯到版友个人就没必要。当然这里的都是熟人，开

起来哪里那么简单。
米国的这种制度注定了庸医很多。用一个朋友的话说，医生大半的时间花在怎么防止
你SUE他而不是积极治疗你。在中国还可以塞红包， 在这里毛都没用。没有治疗结果就
等死吧。耗到死也比误诊你去SUE他强，就这么简单。
所以没事别去医院，去了也抱太大希望。善哉善哉。

的标准——中国刑事诉讼法要求“证据确凿”，美国讲“beyond reasonable doubt". 还
有一些低一些的证据力要求，中国法律并没有明确规定但司法实践中有运用，在其他国家
多适用于犯罪嫌疑人提出的一些defenses 如正当防卫，紧急避险等等，以及民事案件（
比如O.J.Simpson案）
关于刑讯逼供，在我提到的理论中举证责任的分配是这样的：最终必须提出“确凿证据”
证明刑讯逼供没有发生、证据是合法取得的是公诉方的责任。犯罪嫌疑人的举证责任只是
要证明存在一个prima facie case, 也就是some evidence true on its face; such
will prevail unless contradicted，说简单一点就是表明刑讯逼供可能发生（相对于“
证据确凿”而言）。一旦犯罪嫌疑人提出了这样的证据，公诉方就必须证明非法取证没有
发生，而且这时对公诉方的要求是证据必须“确凿”。

just my impression: motive is not a requirement for a prima facie case, but it
may be considered for the penalties finally imposed. I rembered at least
regarding to federal court lawsuits, there is an agency to propose the
guidline about the range of penalty imposed on the defendant although the
offense may be decided by the court.It is just unimaginable that the motive

given instead of ( or at least together with) the dp rejection. But seems
that the dp rejection also focused on the obviousness, anyway. I agree
with DANIELSD on the prior art citation and anything (including any
publications with the same authorship) before the earliest filing date (e.g., Oct 2008 if no priority claimed) could be cited and/or

在中科院读书期间发的中文文章。2 篇英文文章都是在2007年底发的。因为文章较新，
引用次数也很少。因为W博士有博士学位，对于申请O-1而言，起码是一个PRIMA FACIE
CASE。
大家知道，在O-1申请中，美国雇主是申请人，外籍员工只是受益人，O-1签证需要由美
国雇主提出申请。问题是，雇主的背景更弱，只是一个非常小的公司，连老板在内只有

公司的财务状况不好，或是在税表上显示的财力不是可以用所谓的Net Assets来证明公
司有能力支付薪水。但是现在AAO又提出一个解释说Net Assets是一 个Prospective(未
来)的数字，因此这个数字是否能真的用上是个问题。AAO的论点是有道理的。因为Net
Assets是需要买点之后才有的资产，但在同时公司也可能还有其它的负债需要付掉。而
付掉之后就不一 定有能力支付薪水了。从这个案件来看AAO是变的比较严格。但是还是
有办法解 决这一问题的。如果公司的财务的 确是有问 题的，申请人可能要先考虑多
付一 点税，先将自己的薪水达到标准，如果薪 水达 到标准，CIS是可以不看其它财
务资 料的。这薪资的资料我们叫做 Prima facie 证据。如 果薪资不到标准，我 们第
