触到这样的化学试剂，谁有动机谋害朱令，谁有机会下毒。 没错，很多化学实验室的
管理很松，可是没接触过这东西的人根本就不会想象到它的毒性并考虑以它为毒品，而
氰化钾/钠人人知道而且更有效些，即使是学化学的，在朱令事件出来前，有多少知道
铊的毒性大小？或许朱令认识到社会上的一些人，但是那些人要搞到铊又没那么容易，
更别说他们没多少知道铊的毒性了。你孙家人带着证明铊很容易获得这个目的去偷点铊
，目的性那么强那当然可以做得到。假设朱令在酒吧结识了一个心胸狭隘男友而招致杀
身之祸，他会想到专门搞些铊去朱令宿舍毒死她？
假设一个案件成立要证明ABCD，很多人都可以满足其中任何一项，但是所有项都满足的
往往就是凶手一个。
如果在这样的事实下都不能定罪，那实在不知其可也。估计要亲眼看见某人从实验室拿
铊，下毒，朱令服下毒品的连贯过程才能令他们信服。否则，拿铊不能证明下毒，下毒
不能证明就是毒也不能证明朱令服下，朱令服下不能证明偷铊者下毒，这样一来，很多
案件就根本不可能破了。

medicine zhu was taking. If that was never looked at, I doubt it could ever
be proven beyond any reasonable doubt that this was intentional poisoning,
not a pure accident, let alone convicting anybody for it. Even if the

数量和质量上都完胜控方。
还有，退一万步说，GZ要脱罪，辩方并不需要拿出什么有力的证据，他们的底线是，只
要针对控方的故事版本，拿出另一个对GZ有利的，不算非常荒谬的故事版本就可以（
within reasonable doubt)。
现在这个情形完全倒了过来，庭审中辩方拿出一些可信度颇高的证据，然后控方在
cross exam是要硬拗说：你看这个是不是还有另一种（对TM有利的）可能性？- 这表明
,控方在prove beyond reasonable doubt这个标准下，表现完全不及格。他们的那些反
制措施，也就刚好能防止法官把案卷摔在他们脸上让他们滚蛋。 |

海洋保育組織Oceana報告自2010年起，經兩年調查化驗了1,215個海鮮樣本，基因測試
發現，多達33%樣本的基因與標籤不符，最令人震驚的，莫過於「油魚」充「白呑拿魚
」。研究指，巿面出售貼上「白呑拿魚」標籤的魚肉，有多達84%實際上是「油魚」，
壽司店更加是「假魚重災區」，74%食物標籤不正確，食肆出售的海鮮也有38%標籤不正
確。
除了白呑拿魚，普通呑拿魚作假也嚴重，多達59%是其他魚類冒充。不過最嚴重要數鯛
魚（snapper），多達87%的標籤為「鯛魚」的，實際上是其他魚類，他們在全美國搜購
的120個鯛魚樣本中，僅7個是真正的鯛魚。

我上面明确说了“对着法庭plead guilty”，就是说在plea阶段对着法庭作出的才叫
guilty plea。有guilty plea直接就定罪了。所以这是confession直接定罪的一种情况。
2. OJ当然可以plead not guilty，那就进入审判。审判中检察官可以传唤警察作证，
警察可以这样作证：”OJ跟我承认了人是他杀的。“ 警察的这个证词就成为了证据的
一部分，只依靠这个证据本身够不够定罪那是陪审团要考虑的事情。通常只有
confession不足够定罪，虽然confession算是比较强的证据， 但是这样一句证词通常
来说没有强到prove beyond a reasonable doubt。所以检察官还会加入其它证据进行
佐证，多项证据互相印证以求达到prove beyond a reasonable doubt。
但是警察的证词，也就是OJ的confession，确实是证据的一部分，是要被陪审团考虑评

可能性犯罪已经发生了，DA就能charge你。
2. 不要怕DA charge, 他们要convict 你，必须要有证据来beyond reasonable doubt,
有些时候DA也会承受一些压力，或者是来自他办公室的选区，或者是他的上司，所以
他们有些时候会“漫天要价”。他们如果不能convict 你， charge你谋杀都没卵用。
3. DA 的确是控诉你一个“aggravated battery”, 这是battery里面一个加强版本。

尽量避免trial, 失败的trial对DA的业绩是不利的.
别听那些纸上谈兵的doubt不doubt, 美国的这套系统非常容易定人罪, 只要DA能让陪审
员相信他/她超过相信你. 好好和律师谈谈, 多找些亲朋好友为你证明你是个好人. |

发帖数: 6889 | 48 看不懂你要说什么，貌似是用概率推算，米国法律体系冤枉的比例非常少。首先，对应
“51% 的可能性”的是"by a preponderance of evidence"标准。大陪审团米国字面上
是公众仲裁，其实决定起不起诉，用远低于“51% 的可能性”的标准，演变成了检察官
的橡皮图章（除非你是白警察杀有色人），尤其是因为被告根本不知道、不能出席大陪
审团，所以米国民间有“检察官可以让大陪审团起诉三明治、把三明治成为被告的说法
”。定罪的“beyond a reasonable doubt”标准，根本没人敢讲是“95%”的“可能性
"（确定性？），因为如同前面law.com上讲的，“beyond a reasonable doubt”是很
模糊的。没钱请钟点私人律师，那些指派律师要么是拿政府的钱的（自己还想变检察官
呢），要么是私人律师拿法庭拨款7000起，封顶10000多的，而且不管怎样，客户都排
满，鬼才相信可能都得过检察官。 |

不要把对客观事物的评判卷进意识形态斗争。
这案子很蹊跷，就目前双方透露的内容，我倾向于相信老张是无辜的。
尤其是以小女孩父母名义写的那些文字，根本看不出来这是受过高等教育的家庭，言语
混乱，毫无逻辑，过分强调主观，对客观环境一笔带过，感觉很心虚。
尤其是以上帝名义诅咒，真是猥琐到家了。
