据美国会颁布的多德-弗兰克法案(Dodd-Frank Act)，7月15日之后，贵金属场外交易(O
TC)的合法性将被取缔。
所谓OTC交易，就是场外交易市场又称柜台交易市场，柜台交易是指在证券交易所以
外的市场所进行的股权交易。和交易所市场完全不同，OTC没有固定的场所，没有规定的
成员资格，没有严格可控的规则制度，没有规定的交易产品和限制，主要是交易对手通
过私下协商进行的一对一的交易。国内众多的地下炒金平台即便是这种美国OTC交易的中
国代理，而在此法案之后，相信这些美国的地下炒金平台将会把公司总部迁移至伦敦，
以便逃避监管。
此项禁令将从美东时间7月15日下午5点起开始实行，相应的所有公开贵金属持仓也
将关闭。这意味着自该日期以后，美国居民在OTC市场交易黄金、白银均将被视为违法。

are exhibit A. I suspect your plan may also come with all sorts of fees. It
will be fun to find out after August this year when all the 401(k) plans
are required by Dodd-Frank Act of 2010 to report their expenses to
individual employees.

1交易商。不管你基本面分析，或划线多牛掰，账户里的钱拿不出来到头都是一场空。
像我上面说的，经济危机前有很多骗子在网上大行其道，给出的条款全都是too good
to be true,但还是有很多上当的人，有几个外汇论坛，翻翻旧帖，还能看到不少上网
投诉的。出了事能拿回钱来的可能少而又少。哪怕抓住了人，资金也无从追索，比较有
名的案例是前几年的一个Crown Forex,他们的骗局作得很大，也挺复杂，有兴趣的可以
上网查一下。结果判了几个人，钱却不知去了哪里。
不过现在，美国居民有福了，危机后的Dodd-Frank法令强行规定美国居民的外汇账户只
能在NFA注册的交易商开户，而NFA对外汇公司的准备金要求，大概在两三千万美金，以
及各种财务报告备案的要求，还有很重要的一点，把杠杆强行规定在50倍以内。这一套
规定的出台对外汇市场的影响极大，短短几年至少十几个外汇公司退出美国市场，这还
只是算正规有记录的，纯粹的诈骗公司消失了的，不知道有多少，如今剩下的纯外汇交

善和调整，二是各种财经政策的出台对市场本身的影响,第二点就是所谓的基本面分析
，文章可以作得很大，留到后面。针对对第一类来说，个人能作得事情很有限，但不是
完全没有，有个亲身的例子挺有意思。Dodd-Frank出台以后，要求CFTC和CFA制定条例
，对外汇市场加强监管，在正式条例出台之前，先在网上放出来一个草案，给公众90天
的时间回馈意见。草案里的其它条例已经忘记了，但其中有一条在美国不大的个人外汇
市场上掀起轩然大波，很少见的外汇交易商和个人炒家统一起来，在很短时间内征集到
了上万条回馈，印象里是百分之九十几的反对意见，最后逼使监管机构对这个条例作了

太大变动。一是Dodd-Frank，包括NFA，CFTC等等监管机构已经有些矫枉过正，在有效
打击了充斥这个市场的骗局的同时，对这个市场本身的发展也起了一些负面的影响，已
经没有什么需要加强监管的要求。另外是共和党在接下去几年可能会比较得势，比较而
言，会更加倾向于自由市场。
选择交易商的风险和由于市场监管产生的风险讲完，接下去就是要讨论的主要内容。个
人在交易的时候面对市场的风险，这一部分风险的控制全在于自己，没有什么外在理由

现代世界金融规则基本是90年代初建立起来的,90-91年几件大事包括苏联倒台,海湾战
争全面确立了美国的国际霸主地位.从此国际金融秩序都是在美元主导下直至今日.所以
归根结底一切问题都要回到美元的monetary policy.
1990年以前USD的M2 Money Supply基本和US Nominal GDP 吻合, 换句话说velocity of
money supply长期稳定.今天和1990年以前比大概有30%的gap. 91-94年格林斯潘时期
衍生品大爆发加上Fed一些列policy的变更迅速扩大market leverage ratio. 1995年美
元印钞机开动money supply重回5-7%增速,但已经确立的金融杠杆没有明显减少,直接导

第一，CITI不能占有appraisal vendor或者appraisal company的任何share，这个在
Dodd-Frank出来的时候已经很明确了，越是大银行执行的越是严格；
第二，appraisal value这个东西完全不以sale price为指导的，里面涉及到很多东西
，特别是在市场疯狂的情况下，appraisal value低于price再正常不过了，泡沫产生的
过程总有人要牺牲一点。
第三，感觉这里面loan officer也有责任，在这种特殊的情况下，应该适当的提醒，但
你要说整个CITI都不好，难免以偏概全了，提到某个branch应该就差不多了(大银行一
般一个branch就那么一两个负责loan的） |

人家爱尔兰首相已经说了要银行分担风险。后来看市场气氛不对，又软化了。
就算欧洲事情完了，美国政府现在政治压力上要限制金融。是个人都批评GS啥的。dodd
frank一天没说取消或什么细节，金融一天都难有安宁日。 |
