这项要求及其他建议的法规，可能令公司以H-1B签证来聘用员工更加困难及昂贵。
洛杉矶移民律师Paul Herzog表示：「他们是首次在招聘上作出规定。这影响重大。这

双管齐下要时间的，要论证的，要研究数据的，现在有人觉得此信如果不立刻发出去，
七月排期就要印度人大进，关键词是＂立刻＂、＂赶紧＂、＂现在＂、＂先发了再说＂
、＂否则老印排期就要大进了＂、＂赶紧行动吧。老印要大跃进了＂，哪里容得下双管
齐下？
目标是要争取更多的SO。大家是一致的。
一种方法是跟奥本谈分配技术，在百分比上面做文章。即现有的版本，发出去只不过是
几毛钱邮票的事情，分分钟都可以发。
另外一种思路是告奥本纵容ICC，罪名是negligence，ICC abuse美国移民制度已经有先
例可循，ICC公司曾经通过赔款私了过，看下面链接和思路。
数据还是有的。下面是我能够put together的一些资料和思路，但是缺少人批评或支持
。因为大家现在比较愿意和奥本谈百分比。而我和他谈百分比谈了三年了，至少有十几
个回合吧，发现他在这个话题上已经就轻驾熟，油盐不进。

及公司里的印度consultant讨论这个事，感觉对EB移民乃至几个相关的行业的影响都是
很深远的。有以下几点：
第一：大量小ICC开始破产。ICC是一个竞争激烈的行业，不像大家想像的那样一本万利
。大部分ICC的盈利水平都不高。能够维持的几乎唯一原因就是印度H1的漫长排期和
PERM的高度不确定性，造成一个印度H1一旦在某个ICC的PERM批准，他们都不愿意离开
。EO提到的换雇主PERM无需重办，140发EAD都造成ICC对排期中的H1失去控制。大批这
样的H1要么选择cut更低的雇主，要么选择直接跟first level vendor签合同。这个变
化使得勉强度日的ICC无法维持运作。他们只有一个选择，就是推迟办绿卡，但是这样
员工就会跳到愿意提前办绿卡的竞争对手去。所以不马上办绿卡留不住人，马上办绿卡
也留不住人，这样的大环境下ICC之间很快形成恶性竞争，最后一起死掉。最后能生存
的只有少数几家有能力从印度直接搬运员工的大ICC，比如TCS，Cognizant， 等等。

主流媒体“洛杉矶时报”2日头版头条报导罗兰冈中国小留学生殴打折磨同学案，并使
用本报记者拍摄的照片压在头题上方。但在洛时网站上，主流网民的评论却突显“拉仇
恨”，从月子中心到小留学生增加，都成了美国人恐惧甚至仇恨华人的借口。当天洛时
网站上还刊登加州大学招收国际学生和外州学生越来越多的新闻，更为“拉仇恨”提供
更多弹药，视中国人为洪水猛兽。
洛时报导，将中国学生称为“降落伞小孩”（parachute kids），描述他们脱离父母的
管教，漂流到异国他乡求学，而在美国却社交圈子太小、无人管束，做出令人发指的事
情。本报记者张越在法庭上拍摄的照片，成为头题照片。
