2013年来美国，所以2015年算resident alien，但是还在treaty的36个月以内。老婆J2
没有收入，孩子2015年初出生。因为treaty的原因，学校的payroll给我发的工资都没
有扣联邦税，有1042s和w2，1042s的gross
income就是我的总收入，w2的box 1是0。这种情况下我能不能claim additional
child credit？考古之后发现有三个观点：
1. 不能claim，“你都没交税，还想有退税？”
2.不能claim，因为你的w2的box 1为0,1040表的box 7的wages是0，最后导致8812表格
的child tax credit也是0.
3. 可以claim. 把1040表的box 7的wages填成1042s里面的gross income, 然后在1040
表格的box 21减去gross income （china treaty），这样8812表格的child tax
credit就有$1000了。

support如果是1000块每月，丈夫对家庭收贡献60%，妻子贡献40%的话，丈夫则要支付
小孩每月600块的child support(60%).
别的day care啥的，都是这么按比例算的。
所以女人千万别太能干、别太独立，不然离婚了老公拍拍屁股走人，he has nothing
to lose. 别怪女人太功利，都是这个社会逼的，找个收入高的，离了婚拿child
support都可以拿多点。
自己拼命工作挣钱的，最后连法律都不保护你。 |

前几天和朋友说起，美国体制上很大的优势是它的法律系统， The judiciary is not
corrupt. 在美国，你的权利被侵犯时候，你可以上法庭告任何人，包括告政府和警察
。这里当然希望所有家庭都幸福美满，不过不幸中的女人要知道如何保护自己，保护自
己的权利和财产，找个好律师，让法院为你做主。
说说那个案子，Holding好像有点不关题，是关于Jurisdiction。 案件中男人有被证实
的家暴，不过他好像是个好父亲。女人多次谎称Child Abuse， 女人的Credibility 受
到很大质疑。 同时，她严重违反法院判决，拒绝父亲探视孩子，被判Criminal
Contempt。 这个案子说明的一个问题不是Child Custody， 而是告诉你千万不要向法
院撒谎， 法官讨厌Liar， 律师也不喜欢代表Liar，因为Liar 的谎言被戳穿后，往往
把律师置于很不利的位置（突然出现的不利证据）。

Yes, when MFS, there are some credits that can not be claimed, such as child
and dependent care credit, EIC. But IRS does not exclude Child Tax Credit
for MFS.
Meanwhile, the higher income person may pay more tax because more income
falls in higher tax bracket. However, if the lower income person can get
child tax credit, the overall still is more than MFJ. |

when MFJ will not have any child tax credit, but MFS can get full $2000 for
two kids.
I brought up this question because we can only get part of child tax credit
if MFJ. And I happened to read the rule for child tax credit. I just wish I
have read the rule 5 years ago. I did not pay attention to the details
because I always used tax software to do the return. |

去，加起来不超过20小时，因为妈妈生病10月回国，今年3月回来看到他们关门了，电
话，电子邮件都没人回应。网上跟Better Business Bureau反应情况，答复说他们这样
的案例没法处理，因为child care center已经bankcrupt了。一百多块钱是一方面，主
要我觉得那个child care center关门之前要跟家长打个招呼吧，那时我在国内，但老
公在这边,没有接到电话通知或邮件。大家知道还可以向什么部门反应呢？多谢！ |

的小孩子discipline的时候time out没有用的，因为他们聪明。要得讲道理。
我以前一直不觉得自己的小娃有多聪明，不相信老师跟我说小孩子聪明，以为是对我贿
珞性的表扬，因为要出钱上学嘛。可是最近2-3个星期我确定了老师对小娃的说法。突
然觉得我自己一点准备没有，自己非常缺乏教育和引导这样的小孩的知识和经验。
回忆起来他小时候的很多事情，确实符合儿科医生说的gifted child特点。 这个对我
和对孩子来说都是一个挑战。
请教有经验的朋友介绍一下自己的经验，并且推荐一下有什么好的书给gifted child父
母看的。
说实话，我更关心孩子的社会能力，健康的心理素质，人际关系的应变能力。这些好了
，学业方面的好只是锦上添花而已。

打电话过去argue，被踢皮球n次，终于找到一个明白人，
说NR也qualify child credit，处理的人认为我们是
claim dependent。
要的方法是file 1040x，写明原因：不是claim dependent，是
要qualifying child credit。同时附上原始的tax file，1901表格等。
说不能电话帮着改。

1040报税，孩子非美国出生，可不可以同时申请EIC(child)和 Child tax credit，如

Additional Child Creddit是Up to $1000 per qulified child，
(taxible income - $8500) x 0.15
如果你收入不够高的话（比如我），确实拿不满
你一年需要交税的收入只有$11,580 ? |

我的小孩2006美国出生，2008年全年在中国。我用freetaxusa and Turbotax软件都给
了additional
child credit 1000$, 填报的选项是：小孩和我们在一起<6 months; 而我用另一软件
，则没有任何
child credit,填报的选项是：小孩和我们在一起 0 months。
我看了一下说明，似乎qualifying child要求living with us > 6 months, 我的小孩符
合qualifying relative dependent,但是这不能check line 6c column 4。
I hope to see your opinion.

1. pass substantial presence test
2. less than 19 or under 24 if a student
3. live with you for more than half of 2008
4. you provide over half of his/her support for 2008
are considered as qualified dependant child for child tax credit/additonal
child tax credit if your household income is qualified. |

我看了说明,1040说明书17这么说的;
..如果你qualifying child dependet 的话,那么:
was the child a US citizen, US national, or US resident alien?
如果回答是Yes,就可以要Child Tax Credit.
我理解,税法上的 US resident alien跟移民法上不同,只要符合1040(而不是1040 NR)
的,都是税法上的US resident alien.
回到我的疑问上:
非美国出生的US resident alien小孩,也能要Tax Credit吗?
请知情人赐教.

对于Form 1040的line 52中Child tax credit, 按照instruction
page 43 worksheet, 在line 4就stop了，说may be able to take
the "additional child tax credit", 要填Form8812来算.
最后，从Form 8812中算下来，还是应该拿$1000 的additional
tax credit, 填在Form 1040的line 66中。
真是搞不懂为什么不在line 52就填上，非要再弄个F8812来填？
大家有宝宝的，有同样经历的吗？
