crashing in Ed Levin County Park in Milpitas, according to the Santa Clara
County Sheriff's office.
The man was paragliding off Monument Peak Trail when his equipment

員時，被查出身懷20包海洛英毒品。市教育局要開除這名教師，一名法院仲裁人也同意。
但曼哈坦最高法院曼德斯（Manuel Mendez）不同意，他在意見書上寫道：「沒有證據
證明他被控的行為影響他的教學。」曼德斯命令市教育局：可以處罰艾斯特班，但不能
開除他。
曼德斯寫道：「無薪停職似乎是比較適合的處分。」
彭博市長和市府律師非常不滿法官的裁定。彭博痛批：「法院仲裁人以這名教師持有20

党而申请政治庇护的决定： Y.C. v. Holder， X.W. v. Holder。 Y.C.和X.W. 是中国
申请人的缩写, Holder 是美国司法部长。 这个案例的核心是当事人仅仅提供从中国寄
来的一封家信或在美国发表一两篇文章不足以证明中国当局知道他们在美国的活动。
联邦法院最后做了一个非常政治化的评论， 大意是：最近有很多中国公民要求联邦复
核移民上诉委员会否定他们的政治庇护申请。仅就反对计划生育来说，中国有13亿多人
，以此为理由申请政治庇护的潜在申请者就可能达到上百万。问题更为复杂的是，有很

，只是需要我帮忙。我当然知道他们靠不住，好不容易自己写好六封推荐信发给律师，
让他们用自己的模版再copy paste推荐信，发现他连copy&paste都懒得干。 现在他还
没有加exhibit，说是初稿。他的意思是移民局的搭眼一看就得出结论了，你写的很长
