1 有没有短期内需要更新的大项目，主要是主体结构，屋顶，水和电，INTENET的基本
设施。
2 有没有短期内到期的租客特别是大租客

Exempt to regular H1-B?
A: If you have only held H-1B Exempt status, and have not worked for a non-
exempt (i.e. - "regular") U.S. employer, you cannot file a transfer "freely"
. You would need to be counted under the H-1B cap at least once. Your
transfer petition would need to be filed April 1, 2008 and be subject to the
lottery for the 65,000 available H-1B visas under the cap.

你申请cap subject的h1b，申请递交了就可以从non-profit转过去工作了，而且只要
approved，就可以继续工作到10/1。
大家有实例这样的吗？ |

能会派我去，因为
有语言沟通的优势。本人H1B申请当中，不出意外的话，很快能批准，但是OPT已用完，
现在是Cap-
Gap，网上查到的和学校国际学生处的说法都是不建议回去，因为到时没有有效的签证
回来。想问问各
位，特别是有过类似经验的大侠，到底能不能回去，有没有其他途径？提前谢谢各位了

种原因又返回学校继续F1了。我知道H1B在10月1日
开始生效，8月份回学校的时候学校要求我向USCIS
申请H1B的withdraw，否则I-20无效，所以我8月
份申请了withdraw。一直到11月初才收到USCIS的
decision letter说withdraw成功.
我这个情况有没有占到那年的cap,马上毕业再去申

年后，也就是上周四，公司找了个移民律师和我谈了我的身份。我现在用OPT工作，4月
到期。我感觉non profit的公司都可以申请cap exempt的H1B，律师说只有两种可以，
一种是高校或和高校相关，另一种是研究机构。面试我的公司不确定是否属于第二种，
要确认。
紧接着对方公司check了我的reference。我的reference都会给我很好的
recommendation。应该没问题。
我本以为快有offer，结果等到今天还是没有音信。想来想去，可能就是H1B申请有问题
。那个公司以前不sponsor，现在开始接受需要sponsor的candidate。
今天忍不住发信给人力资源（借口问他们找我的reference有没有困难，因为之前他们
需要我帮助找到我的references）
现在还没有回信。原来对这份工作颇有信心，现在有点慌。希望版上有朋友能确认一下
是不是所有non profit都可以办cap exempt的H1B。我真不希望最后因为身份原因失去
这份工作。 |

止工作，直到10.1后继续。也就是说从cap-exempt到cap-subject可以在H1B申请
pending的过程工作。建议咨询一下律师。

, the cap-gap stops (=F1 ends). So if the new H1 filed when you are still in
cap-gap, your stay should be fine during new H1 pending, but may be you
should not work since your OPT already expired before this H1 received date.
There's no official interpretation on this, and it's just my
interpretation. |

申regular的会有差么？ 因为急着拿h1B,所以不是很想等到明年了。。。
但又不知道如果这样申regular的，会不会对以后的绿卡有影响呢？
还是说还可以继续提交master cap，但是占用regular的名额而已？

满, you can apply regular if you have master or above degree. |

on the cap H1 sponsorship) to reenter.
USA don't have manpower to target you or raid your workplace during 4-1 to 9
-30, and after your reenter using new H1 visa stamp, the officer
adjudicating your i-485 won't bother to check your past H1B gap that
happened before your last entry.

A不要脸，H1B approve的时候我已经离职，他家给我withdraw了。
加盟公司C，他家答应给我办H1。A家的律师也曾经说过我这种情况不是cap-subjective
的，我完全可以利用A的cap申请新的h1，我合适了一下发现的确如此：

因为我的OPT还有两个月就要过期，这段时间我要么把H1定下来，要么把OPT extension
定下来。。现在问题在于：如果我现在申请，我是不是非要等H1批下来以后才能继续工
作？还是说像OPT extension那样只要有个移民局的收据，不用等批下来就可以继续工
作？

10月底提交H1B申请。今天给学校写邮件问起Cap Gap的事情，不料竟然被告知：
Please send me proof of the H1B filing right away. SEVIS has misapplied

Cap Gap in your situation and has actually SHORTENED your OPT in SEVIS
incorrectly to 09/30/2011. I need this information so that I can contact
the
SEVIS Help Desk to get this corrected.
请问这是谁的疏忽？结果很严重么？会不会拖延H1B审批的时间？今天我公司的主管还

So, does stem OPT matter the H1-B Cap-gap extension in a way like whether A
is E-verified or not?? Or Stem extended OPT cannot extended anymore, sth
like that?
Am I still qualify for cap-gap extension?
I am employed for company B until next year the new company A file h1-B for
me.

在grace period申请了H1b就可以留在美国一直到10月1号（cap-gap）；但是不能工作
。所以3月到10月就呆在这里不工作。
否则也可以找cap-exempt的H1b |

part-time H1-B和cap-exempt H1-B是link的话,cap-exempt H1-B没了,USCIS会不会取
消part-time H1-B还真不好说.如果可行,下一年肯定要重新申请,毕竟现在这个只是

1.想transfer的话必须在OPT结束前transfer
2.想用post-completion申cap-gap的话必须有degree或者Letter of Completion
3.STEM不能在cap-gap期间申
……
