今天收到NSC的140 approval notices, 终于放下心来.
但是时间太紧.正在抓紧准备485,所以也求大家的祝福.
发66个包子,明天晚上请人代发.
背景上次发包子的时候说过,现在说说时间吧

8月8号, TSC收到我的EB1A和NIW申请
8月9号 (我猜),资料被转到NSC
8月15号,收到receipt
8月18号, NSC收到我的pp申请. 同日,在mitbbs移民版发了66个包子
8月19号,下班回家收到email, EB1a和NIW都被approve了.
律师有些怀疑..是不是电脑出错了.因为niw被approve的太快了.
然后打了电话,确认都approve.
今天收到NSC的approval notices.
正在抓紧准备485,好申请ap和ead,当前的EAD 12月中旬过期,
希望能早些拿到EAD,所以在这里同时求祝福.发66个包子.
一切顺利后还会继续发包子.

1. My wife had her PERM/I-140 approved in Company A, with PD on 2/1/2008;
2. She joined Company B last year and also had her new PERM/I-140 approved
this year;
3. She was just laid off by Company B (but can work through 9/30/2011), and
her 6-year H1B will expire on 5/15/2012 (8 months);
4. She got a offer from Company C who will start to transfer her H1B in next
week

今天早上check e-mail and see the approve notice. I just couldn’t believe it
until now. I and my huband had to read the e-mail and uscis online couple
times and make sure it is real.
My NIW(diy) was approved in June, 2011. One person (his ID is ricelitte)
asked my information about NIW and said I can apply EB1. I would like to

完全理解NON-PP童鞋们的心情! 我也是这一周下定决心要PP,下周又想等了.摇摆不定,
因为是个弱case.
请教问个问题,
EB1B-140 被批后,因为485 con-current filing, 需要我做什么?比如,把approved
notice 寄给USCIS? 我的485case 1290077***, 发现我前后号码都被approved. 是因为

不是Top 10.
NIW 在 2011年6月递交，claim了4项，2011年8月批准。上年排期大进，因为觉的工作
稳定，也受点打击，没有及时跟进(事实证明大错特错）。
学校请的律师，claim了5项 （我建议只claim3项，律师不理我）。
律师一开始就强调我NIW已经批准。I am the first one in the USA... (我曾经帮大
公司做过一个项目，老美项目负责人自己帮我写了一份推荐信，里面强调 Dr
XXX is the first one in the USA to XXXX).
然后列5项:
Paper：
3篇Journal, 20+ Conference Proceedings （个人感觉我的Journal太少，我最弱的环
节，不然可以试EB1a了）
Citations：
自己整理，50+，简单表格，没做什么油灯图。 欧美澳中墨，在我的领域算不好不坏，

很近了！
等了近一年，看着满版的12年10月，11月，12月approved的喜讯，心里早就哇凉哇凉了。
今天早上接到USCIS的email Decision,就说主副二人申请approved,信件通知一个月内
送到。一周前曾经例行公事地催过议员，说是材料被调到资料室了，但是485还没批，
说会帮忙催着要回来。。。猜这可能跟刚刚申请了EAD/AP RENEW有关，当时还挺生气的
，想着就因为你们慢，害得老子还得renew身份，结果反而乱上添乱了。。。刚才查了
下排在我们前面的几个老困难户邻居，暂时还没动静，说明这次找议员的行动可能还是
有点效果的。不过结合Lucky207这个更老困难户的刚刚approve例子，我认为有理由相
信TSC已经开始清理旧债啦！希望各位的绿卡都马上获批，早日结束马拉松似的等待，
情人节了，祝版上各位爱情绿卡双丰收！

一下背景。
专业：chemical engineering PhD, 业内大公司engineer，文章 journal:9(5一作)，
两篇一作是行内ranking top1%杂志invited and highlighted(其实是沾phd老板的光
)，会议:9篇。reviews:60+，引用比较弱，递交时才不到80，其中还有近一半自引。。
。公司我负责的几个项目有十几个美国大媒体的报道，产品也卖到很多国家，但律师没
有单独claim说怕招来不必要的麻烦，只放在contribution说了下。
推荐信：6封+2封审稿证明。6封里面4个独立，来自美国，加拿大，中国，除了PhD老板
是院士其它推荐人都不是牛人，加审稿中国推荐人一共3个，一直担心中国推荐人多
会不会有影响，事实证明没有，所以大家放心找咱国人签吧！
律师用的是公司指定的F家律师，开始担心会不会像版上说的F家律师的总总不好，总的
来说感觉他们还是比较负责和有经验的，负责我case的paralegal感觉很有经验，比如

副卡9/6 下午的时候765显示new card is being produced，131还是显示case was
received。现在再去看765变成case was approved了。难道不是应该先显示approve信
息，然后状态改成new card is being produced吗？而且为啥131还是received啊？
另外指纹schedule的是16号8点，今天LD去walk in不给弄，只能乖乖16号再去了。预约
时间是早上8点，迟到没事吧？

140 approval notice (I-797) 上却写着要consular processing:
“The above petition has been approved. We have sent it to the Department of
State National Visa Center (NVC)... NVC processes all approved immigrant
visa petitions that need consular action. It also determines which consular
post is the appropriate consulate to complete visa processing. The NVC will
then forward the approved petition to that consulate.”
我记得之前交的140表格上选了在美国调整身份

您说的是AC21吧：只要140被approve，而且485 pending 超过180天, 140就不会被撤回
了吧。 我们之前的理解也是这样的，不过新公司的法律部门（头衔好像是Senior
Paralegal）的一席话让我们很紧张：
If your employer withdraws the I-140 within 180 days of the I140 approval,
your approval will automatically be revoked and you will not be able to use
the approval for extensions of H-1B status beyond the six year maximum.
不知道是他不懂还是我们理解错了，他掐算180天怎么按照I-140 approval往后啊。。
。这已经超出了我的理解范围。。。请问这里有什么是我们忽略的吗？ |

My wife's company lawyer initiated her H1B transfer last month through
REGULAR processing, till now we haven't got the approval notice yet. When we
submitted the H1B transfer in October, her PD wasn't current.
This week her PD gets current (Her PD is Feb 2008), so I am concerned about
her H1B approval after I-140 approval.
As I heard, the condition for the 3-yr H1B extension with I-140 approval is

You don't need to wait the approval of 'X'. You can file H1B as long as you
have a job offer.
I got laid off in May. I filed B2 application at the same day (by attorney).
And i got a job 2 weeks later. The company's attorney file the H1B
mentioning that I have B2 pending. But the funny thing is the USCIS approved
my H1B but my B2 was still pending.
So, I think the company's attorney forgot to mention my B2 case in the cover

文档，包括140表，上面盖了个approval的章，但是没有approval notice。
现在的问题是如果换工作的话，在新公司重新办理perm,如果用我现在的排期，我是不

版上常说拿到140approval就可以了。现在这个盖了approval章的140表是不是也可以？

基本情况是，去年10月1日H1生效，不幸10月14日被雷。 10月18号提交的转B2的申请
，10月26日H1被原公司revoke
今年1月底得知B2 approve，延长合法在美日期到4月初。 同时2月初拿到一家公司
offer， 昨天刚办好LCA， 律师正在准备提交H1的申请。 昨天律师邮件说， 准备以
out of country CP方式提交H1申请，approve之后需要离境再回来开始工作。当时我回
复商量，能不能走境内change of status，这样有可能在境内拿到i94。但今天律师回

可以。 但是foia 发来的是140 申请的表格， 虽然上面有approve 的章子， 随后发信
问了下uscis， 说需要的是i797（approve notice) , 是不是他们发错了. 得到的回
复是说他们15年来 ， 就不保存approve notice 了。 但是律师还是要求approve
notice (i 7897)， 大家有遇到同样的情况的吗 ？谢谢了。 |

身份确实目前是这个ead的基础，但是h4身份你显然已经得到了（网上状态查询和收到
ead都足以证明）。539 approval notice没有收到是个没有实质影响的瑕疵（当然如果
你不是即将出镜，539 approval notice还是有意义的，毕竟办有些事只认这个作为身
份证据，因此可以要求补发）。
但由于你即将出境，539不是petition，只是转换身份，其作用只及于境内（及前往加
拿大和墨西哥小于一个月）。超出这个范围539，approval，denial都没有意义。
approval的h4身份也在你离开北美范围或在加拿大墨西哥呆超过一个月的时候自动失效
了。
你要回中国再回美国，想要继续使用那个ead，前提是在入境时取得基于同一个h1的h4
身份。而要达到这个目标，你需要领事馆发的有效h4签证。在领事馆申请h4身份需要h1
的797 approval notice（copy），以及婚姻关系证明。如上所说，539在这个情况下毫
无意义。所以对你而言要不要补发无所谓。 |

听说看房子最好准备好贷款的pre-approval letter，这样一旦看中可以很快下offer。
我们是新手没经验,就直接到开户行要求办pre-approval letter。按银行loan officer
的要求递交材料几天后，就收到pre-approval letter.但是上面写的是conditional
approved.然后loan officer催着我们到他们网站再交一些材料。说是这样可以fully
underwritten.
我们还没找到合适的房子，也没决定一定要在开户行贷款。想请问对贷款熟悉的大牛如
下几个问题：
1）fully underwritten 有什么好处？是不是说一定能向开户行贷到款？这样下offer
时可以不要loan contingency?
2）如果fully underwritten 了，是不是说只能向开户行贷款，不可以再找其他银行了？
